Section 1 Short title
This Act may be cited as the “Lake Erie Water Quality Protection Act”.
Lake Erie Water Quality Protection Act
A BILL
To provide for the implementation of dredged material management plans at certain federally authorized harbors, and for other purposes.
Sec. 2 Dredged material management plans
In general— The Secretary of the Army (referred to in this section as the “Secretary”) shall prioritize implementation of section 125(c) of the Water Resources Development Act of 2020 (33 U.S.C. 2326h) at federally authorized harbors in the State of Ohio.
Requirements— Each dredged material management plan prepared by the Secretary under section 125(c) of the Water Resources Development Act of 2020 (33 U.S.C. 2326h) for a federally authorized harbor in the State of Ohio shall—
include, in the baseline conditions, a prohibition on use of funding for open-lake disposal of dredged material consistent with section 105 of the Energy and Water Development and Related Agencies Appropriations Act, 2022 (Public Law 117–103; 136 Stat. 217); and
maximize beneficial use of dredged material under the base plan and under section 204(d) of the Water Resources Development Act of 1992 (33 U.S.C. 2326(d)).
Savings provision— This section does not—
impose a prohibition on use of funding for open-lake disposal of dredged material; or
require the development or implementation of a dredged material management plan in accordance with subsection (b) if use of funding for open-lake disposal is not otherwise prohibited by law.
