OSHA ETS Clarification Act of 2022
A BILL
To amend the Occupational Safety and Health Act of 1970 to clarify the scope of the authority for emergency temporary standards, and for other purposes.
Sec. 2 OSHA emergency temporary standard
Section 6(c) of the Occupational Safety and Health Act of 1970 (29 U.S.C. 655(c)) is amended—
by striking “and (B)” and inserting “(B) the exposure to the substances, agents, or new hazards arises exclusively from within the workplace to be covered by the emergency temporary standard, or is unique and specific to the workplace to be covered by the emergency temporary standard, and (C)”; and
by inserting “within the workplace” after “such danger”.
