A BILL

To amend title XVIII of the Social Security Act to extend the pass-through period for certain devices.

Section 1 Short title

This Act may be cited as the “Innovative Technologies Impacted by COVID–19 Act”.

Sec. 2 Extending pass-through status under the Medicare program for certain devices

Section 1833(t)(6) of the Social Security Act (42 U.S.C. 1395l(t)(6)) is amended by adding at the end the following new subparagraph:

“(K) Pass-through extension for certain devices—In the case of a device with respect to which the pass-through status under this paragraph would, but for application of this subparagraph, end on December 31, 2022, such pass-through status shall be extended for the 1-year period beginning on January 1, 2023.”
