_______ Act of 2022

A BILL

To restrict limitations on the possession, sale, purchase, transportation or use of any contraceptive that relates to interstate commerce.

Section 1 Short title

This Act may be cited as the “_______ Act of 2022”.

Sec. 2 Prohibition on limitation

No person, acting under color of law, who is a State or local official, may prohibit or take any action to restrict the possession, sale, purchase, transportation or use of any contraceptive that relates to interstate commerce.

Sec. 3 Enforcement

(a)
Private right of action— Any person injured by a violation of this section may bring a civil action against that person before any appropriate Federal district court for injunctive or declaratory relief.
(b)
Department of Justice— The Attorney General may bring a civil action to remedy any violation of this section for injunctive or declaratory relief before any appropriate Federal district court.

Sec. 4 Definition

The term contraceptive means any device or drug the primary purpose of which is to prevent pregnancy, including—
(1)
prophylactics or condoms;
(2)
intrauterine devices;
(3)
any pill, drug or prescription medication whose primary use is to prevent pregnancy;
(4)
any FDA-approved medication, device or other product whose primary purpose is to prevent pregnancy; and
(5)
any FDA-approved drug, pill, or medication, the primary purpose of which is to prevent pregnancy if administered or ingested within five days following sexual intercourse.
