Death Penalty for Dealing Fentanyl Act of 2022

A BILL

To amend the Controlled Substances Act to provide for punishment for the knowing distribution of fentanyl, if death results, and for other purposes.

Section 1 Short title

This Act may be cited as the “Death Penalty for Dealing Fentanyl Act of 2022”.

Sec. 2 Knowing distribution of fentanyl where death results

Part D of the Controlled Substances Act is amended by adding at the end the following:

“424. Knowing distribution of fentanyl where death results

“Any person who knowingly violates section 401(a)(1) or section 416 by distributing, possessing with intent to distribute, or manufacturing fentanyl shall, if death results, be punished—

“(1) by death or imprisonment for any term of years or for life; and

“(2) by a fine under title 18, United States Code.”
