A BILL

To amend title XVIII of the Social Security Act to repeal the private cause of action for damages in the case of a primary plan which fails to provide for primary payment or appropriate reimbursement.

Section 1 Short title

This Act may be cited as the “Repair Abuses of MSP Payments Act” or the “RAMP Act”.

Sec. 2 Repeal of private cause of action for damages in the case of a primary plan which fails to provide for primary payment or appropriate reimbursement

Section 1862(b)(3)(A) of the Social Security Act (42 U.S.C. 1395y(b)(3)(A)) is repealed.
