Preventing Investment in the Chinese Solar Economy Act
A BILL
To amend the Defense Production Act of 1950 to prohibit the use of certain authorities under that Act with respect to solar photovoltaic modules and module components, and for other purposes.
Sec. 2 Prohibition on the use of authorities for solar photovoltaic modules and module components
Section 104 of the Defense Production Act of 1950 (50 U.S.C. 4514) is amended by adding at the end the following:
“(c) Electric vehicles and related technology—The authorities provided under this title and title III may not be used with respect to solar photovoltaic modules and module components, including ingots, wafers, solar glass, and cells.”
Sec. 3 Termination of memorandum
The memorandum of the President titled “Memorandum on Presidential Determination Pursuant to Section 303 of the Defense Production Act of 1950, as amended, on Solar Photovoltaic Modules and Module Components” (published June 6, 2022) shall have no force or effect.
