Section 1 Short title
This Act may be cited as the “Restaurant Revitalization Fund Fairness Act”.
Restaurant Revitalization Fund Fairness Act
A BILL
To require the Administrator of the Small Business Administration to award Restaurant Revitalization Grants to certain eligible applicants, and for other purposes.
Sec. 2 Restaurant Revitalization Grants for certain eligible applicants
In general— The Administrator of the Small Business Administration shall, in accordance with section 5003(c) of the American Rescue Plan Act of 2021 (15 U.S.C. 9009c(c)), award grants to eligible applicants.
Review— The Administrator shall review and process applications from eligible applicants in the order in which they were originally received.
Repeal—
In general— Paragraph (3) of section 5003(c) of the American Rescue Plan Act of 2021 (15 U.S.C. 9009c(c)(3)) is repealed.
Conforming amendment— Section 5003(c)(1) of the American Rescue Plan Act of 2021 (15 U.S.C. 9009c(c)(1)) is amended by striking “and paragraph (3)”.
Definitions— In this section:
Administrator— The term Administrator means the Administrator of the Small Business Administration.
Covered period; eligible entity— The terms covered period and eligible entity have the meanings given, respectively, in section 5003(a) of the American Rescue Plan Act of 2021 (15 U.S.C. 9009c(a)).
Eligible applicant— The term eligible applicant means one of the 177,300 eligible entities identified by the Administrator that applied during the covered period for a grant under section 5003(c) of the American Rescue Plan Act of 2021 (15 U.S.C. 9009c(c)) and was not awarded such a grant.
Appropriation; offset—
In general— There is appropriated, out of amounts in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2022, $43,658,300,559, to remain available until expended, for the Administrator to carry out this section.
Offset— Not later than 30 days after the date of the enactment of this Act, there are hereby rescinded $43,658,300,559, to be derived, as determined by the Secretary of the Treasury, from the unobligated amounts available under the following:
The Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (Public Law 116–123).
The Families First Coronavirus Response Act (Public Law 116–127).
The Coronavirus Aid, Relief, and Economic Security Act (Public Law 116–136).
The Paycheck Protection Program and Health Care Enhancement Act (Public Law 116–139).
Divisions M and N of the Consolidated Appropriations Act, 2021 (Public Law 116–260).
The American Rescue Plan Act of 2021 (Public Law 117–2).
