Arlington Cemetery Marker Fairness Act

A BILL

To direct the Secretary of the Army to authorize the placement of certain types of private headstones in Arlington National Cemetery, and for other purposes.

Section 1 Short title

This Act may be cited as the “Arlington Cemetery Marker Fairness Act”.

Sec. 2 Placement of certain private headstones in Arlington National Cemetery

(a)
In general— The Secretary of the Army shall authorize the placement in a covered area of Arlington National Cemetery of a private headstone if such headstone—
(1)
is placed within 20 feet of another private headstone;
(2)
is not larger than the plot on which it is placed;
(3)
meets the specifications provided in the Arlington National Cemetery Memorialization Policy, as in effect on December 31, 2016;
(4)
is not a ledger, marker of freestanding cross design, narrow shaft, mausoleum, or overground vault; and
(5)
does not exceed four feet in width and four feet in height, including both the base and the die.
(b)
Definitions— In this section:
(1)
The term “private headstone” means a headstone other than a standard white uniform military grave marker.
(2)
The term “covered area”, with respect to Arlington National Cemetery, means an area within one of the original 13 sections of the cemetery that were designated for private markers.
