A BILL

To prohibit settlement negotiations and agreements in certain cases, and for other purposes.

Section 1 Short title

This Act may be cited as the “Preserving the Integrity of Our Laws Act of 2021”.

Sec. 2 Prohibition on settlement negotiations and agreements

(a)
In general— Neither the head of any Federal agency, nor any individual who is an officer or employee thereof, may enter into a settlement negotiation or agreement with an alien who—
(1)
brings a civil action against—
(A)
the United States; or
(B)
an individual sued in the individual’s official capacity as an officer or employee of the United States; and
(2)
entered the United States unlawfully.
(b)
Congressional approval— No amounts may be made available from the Treasury for the payment of a settlement agreement entered into with an alien described in subsection (a) during the period beginning on November 1, 2021, and ending on the date of the enactment of this Act, unless such payment is expressly approved by an Act of Congress.
(c)
Rule of construction— Nothing in subsection (a) may be construed to prohibit any individual, against whom a claim is brought in the individual’s personal capacity, from entering into a settlement negotiation or agreement with respect to such a claim.
