To prohibit in-person instructional requirements during the COVID–19 emergency.

Short title
This Act may be cited as the “Don't Punish Schools for Uncontrolled Pandemics Act of 2020”.

Prohibition of in-person instructional requirements during COVID–19 emergency
Notwithstanding any other provision of law, no rule, regulation, guidance, or policy regarding an applicable program (as defined in section 400 of the General Education Provisions Act (20 U.S.C. 1221)) shall require a local program to conduct in-person instruction during an emergency, as declared by a Federal, State, or local authority, with respect to COVID–19.
