Sec. 2 Requirements for IANA stewardship transition

(a)

changed ~~Retention of responsibilities—~~In general— Until the ~~Comptroller General of~~ date that is 30 legislative days after the ~~United States submits~~ submission to Congress of the report ~~required by~~ described in subsection (b), the Assistant Secretary ~~of Commerce for Communications and Information~~ may not ~~relinquish or agree to any proposal relating to~~ permit the ~~relinquishment of~~ NTIA’s role in the ~~responsibility~~ performance of the ~~National Telecommunications and Information Administration (in this section referred to as the “NTIA”) over~~ Internet ~~domain name system functions, including responsibility with respect to the authoritative root zone file, the Internet~~ Assigned Numbers Authority ~~functions, and related root zone management functions.~~functions to terminate, lapse, be cancelled, or otherwise cease to be in effect.

(b)

changed ~~Report—~~Report described— Not later than 1 year after the date on which the NTIA receives a proposal relating to the relinquishment of the responsibility of the NTIA over Internet domain name system functions that was developed The report described in ~~a process convened by the Internet Corporation for Assigned Names and Numbers at the request of the NTIA, the Comptroller General of the United States shall submit to Congress~~ this subsection is a report ~~on the role of the NTIA with respect to the Internet domain name system. Such report shall include—~~that contains—

(1)

changed the proposal relating to the transition of the NTIA’s stewardship of the Internet Assigned Numbers Authority functions that was developed in a ~~discussion and analysis of—~~process convened by ICANN at the request of the NTIA; and

(A)

removed the advantages and disadvantages of relinquishment of the responsibility of the NTIA over Internet domain name system functions, including responsibility with respect to the authoritative root zone file, the Internet Assigned Numbers Authority functions, and related root zone management functions;

(B)

removed ~~any principles or criteria that the NTIA sets for proposals for such relinquishment;~~

(C)

removed ~~each proposal received by the NTIA for such relinquishment;~~

(D)

removed ~~the processes used by the NTIA and any other Federal agencies for evaluating such proposals;~~

(E)

removed ~~any national security concerns raised by such relinquishment; and~~

(F)

removed ~~any concerns raised by such relinquishment with respect to the security of the Internet domain name system or the security of other information networks and systems; and~~

(2)

changed a definition of the term “multistakeholder model”, as used by the NTIA with respect to Internet policymaking and governance, and definitions of any other terms necessary to understand the matters covered certification by the ~~report.~~Assistant Secretary that—

(A)

added such proposal—

(i)

added supports and enhances the multistakeholder model of Internet governance;

(ii)

added maintains the security, stability, and resiliency of the Internet domain name system;

(iii)

added meets the needs and expectations of the global customers and partners of the Internet Assigned Numbers Authority services;

(iv)

added maintains the openness of the Internet; and

(v)

added does not replace the role of the NTIA with a government-led or intergovernmental organization solution; and

(B)

added the required changes to ICANN’s bylaws contained in the final report of ICANN’s Cross Community Working Group on Enhancing ICANN Accountability and the changes to ICANN’s bylaws required by ICANN’s IANA Stewardship Transition Coordination Group have been adopted.

(c)

added Definitions— In this section:

(1)

added Assistant Secretary— The term “Assistant Secretary” means the Assistant Secretary of Commerce for Communications and Information.

(2)

added ICANN— The term “ICANN” means the Internet Corporation for Assigned Names and Numbers.

(3)

added Legislative day— The term “legislative day” does not include Saturdays, Sundays, legal public holidays, or days either House of Congress is adjourned for more than 3 days during a session of Congress.

(4)

added NTIA— The term “NTIA” means the National Telecommunications and Information Administration.
