Northern Border Security Review Act

Sec. 2 Northern border threat analysis

(a)
changed In general— Not later than six months 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to the appropriate congressional committees a northern border Northern Border threat analysis. Such analysis, at a minimum, shall include the following:analysis that includes—
(1)
changed An analysis of current and potential terrorism and criminal threats posed by individuals and organized groups seeking to enter the United States through the northern border.to—
(A)
added enter the United States through the Northern Border; or
(B)
added exploit border vulnerabilities along the Northern Border;
(2)
changed An analysis of improvements needed at and between ports of entry along the northern border to prevent terrorists and instruments of terror from entering the United States.Northern Border to—
(A)
added prevent terrorists and instruments of terror from entering the United States; and
(B)
added reduce criminal activity, as measured by the total flow of illegal goods, illicit drugs, and smuggled and trafficked persons moved in either direction across the Northern Border;
(3)
changed An analysis of the number of additional U.S. Customs gaps in law, policy, cooperation between State, local, and Border Protection agents tribal law enforcement, international agreements, or tribal agreements that hinder effective and officers needed at efficient border security, counter-terrorism, anti-human smuggling and between ports trafficking efforts, and the flow of entry legitimate trade along the northern border.Northern Border; and
(4)
changed An an analysis of gaps in law, policy, international agreements, or tribal agreements that hinder the border security whether additional U.S. Customs and counterterrorism efforts Border Protection preclearance and pre-inspection operations at ports of entry along the northern border.Northern Border could help prevent terrorists and instruments of terror from entering the United States.
(5)
removed An analysis of illegal cross border activity between ports of entry, including the maritime borders of the Great Lakes.
(6)
removed An analysis of the scope of border security challenges that shall include the terrain, population density, and climate along the northern border.
(7)
removed An analysis of whether additional preclearance and pre-inspection by U.S. Customs and Border Protection at ports of entry along the northern border could help prevent terrorists and their instruments from entering the United States.
(b)
changed Classified threat analysis—Analysis requirements— The For the threat analysis required under subsection (a) may be submitted in classified form, if (a), the Secretary of Homeland Security determines that such is appropriate.shall consider and examine—
(1)
added technology needs and challenges;
(2)
added personnel needs and challenges;
(3)
added the role of State, local, and tribal law enforcement in general border security activities;
(4)
added the need for cooperation among Federal, State, local, tribal, and Canadian law enforcement entities relating to border security; and
(5)
added the terrain, population density, and climate along the Northern Border.
(c)
added Classified threat analysis— To the extent possible, the Secretary of Homeland Security shall submit the threat analysis required under subsection (a) in unclassified form. The Secretary may submit a portion of the threat analysis in classified form if the Secretary determines such is appropriate.
(d)
added Definitions— In this section:
(1)
added Appropriate congressional committees— The term appropriate congressional committees means—
(A)
added the Committee on Homeland Security and Governmental Affairs of the Senate;
(B)
added the Committee on Appropriations of the Senate;
(C)
added the Committee on Homeland Security of the House of Representatives; and
(D)
added the Committee on Appropriations of the House of Representatives.
(2)
added Northern Border— The term Northern Border means the land and maritime borders between the United States and Canada.
