A BILL
To amend title 10, United States Code, to eliminate the age restriction on the commencement of the receipt of retired pay for non-regular service.
Sec. 2 Elimination of age restriction on commencement of receipt of retired pay for non-regular service
Elimination of eligibility age— Section 12731(a)(1) of title 10, United States Code, is amended by striking “person;” and inserting “person, except that, in the case of any person who first enters a uniformed service on or after January 1, 2018, this paragraph shall not apply;”.
Conforming amendment relating to computation of retired pay base— Section 1407(d)(4) of title 10, United States Code, is amended by adding at the end the following new sentence: “In the case of a member or former member who first became a member on or after January 1, 2018, and whose retired pay is covered by paragraph (1) or (2), the 36 months shall only include months for which the member was entitled to monthly basic pay.”.
