Section 1 Exempting from manufacturer transparency reporting certain transfers used for educational purposes
In general— Section 1128G(e)(10)(B) of the Social Security Act (42 U.S.C. 1320a–7h(e)(10)(B)) is amended—
in clause (iii), by inserting “, including peer-reviewed journals, journal reprints, journal supplements, conference reports, and medical textbooks” after “patient use”; and
by adding at the end the following new clause:
“(xiii) A transfer of anything of value to a covered recipient who is a physician if the thing of value is intended solely for purposes of providing continuing medical education to the physician or other physicians.”
Effective date— The amendments made by this section shall apply with respect to transfers of value made on or after the date of the enactment of this Act.
