Federal environmental laws— The term “Federal environmental laws” means laws governing the review of environmental impacts of, and issuance of permits and other approvals for, the construction and operation of projects, including section 102(2)(C) of the National Environmental Policy Act of 1969 (
42 U.S.C. 4332(2)(C)), section 404 of the Federal Water Pollution Control Act (
33 U.S.C. 1344), section 106 of the National Historic Preservation Act (
16 U.S.C. 470f), and sections 7(a)(2), 9(a)(1)(B), and 10(a)(1)(B) of the Endangered Species Act of 1973 (
16 U.S.C. 1536(a)(2), 1538(a)(1)(B), 1539(a)(1)(B)).
