  • (3) For the purposes of paragraph (1)(E), the failure of the borrower-owner to make timely rental payments shall constitute cause for the termination of all rights of such borrower-owner to possession and occupancy of the homestead property under this section. In effecting any such termination, the Secretary shall afford the borrower-owner or lessee the notice and hearing procedural rights described in section 1983b2 of this title and shall comply with all applicable State and local laws governing eviction from residential property.
  • (h) Once an appeal has been filed under section 1983b1 of this title, a decision shall be made at each level in the appeals process within 45 days after the receipt of the appeal or request for further review.
  • (j) An appeal filed with the appeals division under section 1983b of this title may include a request by the borrower for an independent appraisal of any property securing the loan. On such request, the appeals division shall present the borrower with a list of three appraisers approved by the county supervisor, from which the borrower shall select an appraiser to conduct the appraisal, the cost of which shall be borne by the borrower. The results of such appraisal shall be considered in any final determination concerning the loan. A copy of any appraisal made under this paragraph shall be provided to the borrower.
  • (c) Decisions of the Secretary of Agriculture under this section shall be appealable in accordance with the provisions of section 333B1 of the Consolidated Farm and Rural Development Act (7 U.S.C. 1983b).
