(b) Former career members of the Service may be reappointed under section 3942(a)(1) or 3943 of this title, without regard to section 3946 of this title, in a salary class which is appropriate in light of the qualifications and experience of the individual being reappointed.

(1) Every member who is serving under a career appointment or as a career candidate under section 3946 of this title—(A) in the Senior Foreign Service, or(B) assigned to a salary class in the Foreign Service Schedule.

(d) The Secretary may exclude from the operation of this part any member of the Foreign Service, or group of members, whose employment is temporary or intermittent, except a member whose employment is part-time career appointment or career candidate appointment under section 3946 of this title.
