# §8203. Assistance


Subject to [section 8204 of this title](/usc/7/8204.md), the assistance provided by the [Secretary](/usc/7/8201.md?p=3) to [eligible orchardists](/usc/7/8201.md?p=1) for losses described in [section 8202 of this title](/usc/7/8202.md) shall consist of—

- (1) reimbursement of 75 percent of the cost of replanting [trees](/usc/7/8201.md?p=4) lost due to a [natural disaster](/usc/7/8201.md?p=2), as determined by the [Secretary](/usc/7/8201.md?p=3), in excess of 15 percent mortality (adjusted for normal mortality); or
- (2) at the option of the [Secretary](/usc/7/8201.md?p=3), sufficient seedlings to reestablish a stand.
