# §8202. Eligibility

- (a) **Loss—** Subject to [subsection (b)](#b), the [Secretary](/usc/7/8201.md?p=3) shall provide assistance under [section 8203 of this title](/usc/7/8203.md) to [eligible orchardists](/usc/7/8201.md?p=1) that planted [trees](/usc/7/8201.md?p=4) for commercial purposes but lost the [trees](/usc/7/8201.md?p=4) as a result of a [natural disaster](/usc/7/8201.md?p=2), as determined by the [Secretary](/usc/7/8201.md?p=3).
- (b) **Limitation—** An [eligible orchardist](/usc/7/8201.md?p=1) shall qualify for assistance under [subsection (a)](#a) only if the [tree](/usc/7/8201.md?p=4) mortality of the [eligible orchardist](/usc/7/8201.md?p=1), as a result of damaging weather or related condition, exceeds 15 percent (adjusted for normal mortality).
