# §7803. Issuance of orders

- (a) **In general—**
  - (1) **Issuance—** To effectuate the policy of this chapter specified in [section 7801(b) of this title](/usc/7/7801.md?p=b), the [Secretary](/usc/7/7802.md?p=15), subject to the procedures provided in [subsection (b)](#b), shall issue [orders](/usc/7/7802.md?p=10) under this chapter applicable to [producers](/usc/7/7802.md?p=12), [importers](/usc/7/7802.md?p=8), and [first handlers](/usc/7/7802.md?p=7-A) of [Hass avocados](/usc/7/7802.md?p=6-A).
  - (2) **Scope—** Any [order](/usc/7/7802.md?p=10) shall be national in scope.
  - (3) **One order—** Not more than one [order](/usc/7/7802.md?p=10) shall be in effect at any one time.
- (b) **Procedures—**
  - (1) **Proposal for an order—** An existing organization of avocado [producers](/usc/7/7802.md?p=12) established pursuant to a [State](/usc/7/7802.md?p=16) statute, or any other [person](/usc/7/7802.md?p=11) who will be affected by this chapter, may request the issuance of, and submit a proposal for an [order](/usc/7/7802.md?p=10).
  - (2) **Publication of proposal—** The [Secretary](/usc/7/7802.md?p=15) shall publish a proposed [order](/usc/7/7802.md?p=10) and give notice and opportunity for public comment on the proposed [order](/usc/7/7802.md?p=10) not later than 60 days after receipt by the [Secretary](/usc/7/7802.md?p=15) of a proposal for an [order](/usc/7/7802.md?p=10) from an existing organization of avocado [producers](/usc/7/7802.md?p=12) established pursuant to a [State](/usc/7/7802.md?p=16) statute, as provided in [paragraph (1)](#b-1).
  - (3) **Issuance of order—**
    - (A) **In general—** After notice and opportunity for public comment are provided in accordance with [paragraph (2)](#b-2), the [Secretary](/usc/7/7802.md?p=15) shall issue the [order](/usc/7/7802.md?p=10), taking into consideration the comments received and including in the [order](/usc/7/7802.md?p=10) such provisions as are necessary to ensure that the [order](/usc/7/7802.md?p=10) is in conformity with this chapter.
    - (B) **Effective date—** The [order](/usc/7/7802.md?p=10) shall be issued and become effective only after an affirmative vote in a referendum as provided in [section 7805 of this title](/usc/7/7805.md), but not later than 180 days after publication of the proposed [order](/usc/7/7802.md?p=10).
- (c) **Amendments—** The [Secretary](/usc/7/7802.md?p=15), from time to time, may amend an [order](/usc/7/7802.md?p=10). The provisions of this chapter applicable to an [order](/usc/7/7802.md?p=10) shall be applicable to any amendment to an [order](/usc/7/7802.md?p=10).
