# §7714. General remedial measures for new plant pests and noxious weeds

- (a) **Authority to hold, treat, or destroy items—** If the [Secretary](/usc/7/7702.md?p=16) considers it necessary in order to prevent the dissemination of a [plant pest](/usc/7/7702.md?p=14) or [noxious weed](/usc/7/7702.md?p=10) that is new to or not known to be widely prevalent or distributed within and throughout the [United States](/usc/7/7702.md?p=20), the [Secretary](/usc/7/7702.md?p=16) may hold, seize, quarantine, treat, apply other remedial measures to, destroy, or otherwise dispose of any [plant](/usc/7/7702.md?p=13), [plant pest](/usc/7/7702.md?p=14), [noxious weed](/usc/7/7702.md?p=10), [biological control organism](/usc/7/7702.md?p=2), [plant product](/usc/7/7702.md?p=15), [article](/usc/7/7702.md?p=1), or [means of conveyance](/usc/7/7702.md?p=8) that—
  - (1) is [moving](/usc/7/7702.md?p=9) into or through the [United States](/usc/7/7702.md?p=20) or [interstate](/usc/7/7702.md?p=6), or has moved into or through the [United States](/usc/7/7702.md?p=20) or [interstate](/usc/7/7702.md?p=6), and—
    - (A) the [Secretary](/usc/7/7702.md?p=16) has reason to believe is a [plant pest](/usc/7/7702.md?p=14) or [noxious weed](/usc/7/7702.md?p=10) or is infested with a [plant pest](/usc/7/7702.md?p=14) or [noxious weed](/usc/7/7702.md?p=10) at the time of the [movement](/usc/7/7702.md?p=9); or
    - (B) is or has been otherwise in violation of [this chapter](/usc/7/7702.md?p=19);
  - (2) has not been maintained in compliance with a post-[entry](/usc/7/7702.md?p=3) quarantine requirement; or
  - (3) is the progeny of any [plant](/usc/7/7702.md?p=13), [biological control organism](/usc/7/7702.md?p=2), [plant product](/usc/7/7702.md?p=15), [plant pest](/usc/7/7702.md?p=14), or [noxious weed](/usc/7/7702.md?p=10) that is [moving](/usc/7/7702.md?p=9) into or through the [United States](/usc/7/7702.md?p=20) or [interstate](/usc/7/7702.md?p=6), or has moved into the [United States](/usc/7/7702.md?p=20) or [interstate](/usc/7/7702.md?p=6), in violation of [this chapter](/usc/7/7702.md?p=19).
- (b) **Authority to order an owner to treat or destroy—**
  - (1) **In general—** The [Secretary](/usc/7/7702.md?p=16) may order the owner of any [plant](/usc/7/7702.md?p=13), [biological control organism](/usc/7/7702.md?p=2), [plant product](/usc/7/7702.md?p=15), [plant pest](/usc/7/7702.md?p=14), [noxious weed](/usc/7/7702.md?p=10), [article](/usc/7/7702.md?p=1), or [means of conveyance](/usc/7/7702.md?p=8) subject to action under [subsection (a)](#a) to treat, apply other remedial measures to, destroy, or otherwise dispose of the [plant](/usc/7/7702.md?p=13), [biological control organism](/usc/7/7702.md?p=2), [plant product](/usc/7/7702.md?p=15), [plant pest](/usc/7/7702.md?p=14), [noxious weed](/usc/7/7702.md?p=10), [article](/usc/7/7702.md?p=1), or [means of conveyance](/usc/7/7702.md?p=8), without cost to the Federal Government and in the manner the [Secretary](/usc/7/7702.md?p=16) considers appropriate.
  - (2) **Failure to comply—** If the owner fails to comply with the [Secretary](/usc/7/7702.md?p=16)’s order under this subsection, the [Secretary](/usc/7/7702.md?p=16) may take an action authorized by [subsection (a)](#a) and recover from the owner the costs of any care, handling, application of remedial measures, or disposal incurred by the [Secretary](/usc/7/7702.md?p=16) in connection with actions taken under [subsection (a)](#a).
- (c) **Classification system—**
  - (1) **Development required—** To facilitate control of [noxious weeds](/usc/7/7702.md?p=10), the [Secretary](/usc/7/7702.md?p=16) may develop a classification system to describe the status and action levels for [noxious weeds](/usc/7/7702.md?p=10). The classification system may include the current geographic distribution, relative threat, and actions initiated to prevent introduction or distribution.
  - (2) **Management plans—** In conjunction with the classification system, the [Secretary](/usc/7/7702.md?p=16) may develop integrated management plans for [noxious weeds](/usc/7/7702.md?p=10) for the geographic region or ecological range where the [noxious weed](/usc/7/7702.md?p=10) is found in the [United States](/usc/7/7702.md?p=20).
- (d) **Application of least drastic action—** No [plant](/usc/7/7702.md?p=13), [biological control organism](/usc/7/7702.md?p=2), [plant product](/usc/7/7702.md?p=15), [plant pest](/usc/7/7702.md?p=14), [noxious weed](/usc/7/7702.md?p=10), [article](/usc/7/7702.md?p=1), or [means of conveyance](/usc/7/7702.md?p=8) shall be destroyed, exported, or returned to the shipping point of origin, or ordered to be destroyed, exported, or returned to the shipping point of origin under this section unless, in the opinion of the [Secretary](/usc/7/7702.md?p=16), there is no less drastic action that is feasible and that would be adequate to prevent the dissemination of any [plant pest](/usc/7/7702.md?p=14) or [noxious weed](/usc/7/7702.md?p=10) new to or not known to be widely prevalent or distributed within and throughout the [United States](/usc/7/7702.md?p=20).
