# §7713. Notification and holding requirements upon arrival

- (a) **Duty of Secretary of the Treasury—**
  - (1) **Notification—** The [Secretary](/usc/7/7702.md?p=16) of the Treasury shall promptly notify the [Secretary](/usc/7/7702.md?p=16) of Agriculture of the arrival of any [plant](/usc/7/7702.md?p=13), [plant product](/usc/7/7702.md?p=15), [biological control organism](/usc/7/7702.md?p=2), [plant pest](/usc/7/7702.md?p=14), or [noxious weed](/usc/7/7702.md?p=10) at a port of [entry](/usc/7/7702.md?p=3).
  - (2) **Holding—** The [Secretary](/usc/7/7702.md?p=16) of the Treasury shall hold a [plant](/usc/7/7702.md?p=13), [plant product](/usc/7/7702.md?p=15), [biological control organism](/usc/7/7702.md?p=2), [plant pest](/usc/7/7702.md?p=14), or [noxious weed](/usc/7/7702.md?p=10) for which notification is made under [paragraph (1)](#a-1) at the port of [entry](/usc/7/7702.md?p=3) until the [plant](/usc/7/7702.md?p=13), [plant product](/usc/7/7702.md?p=15), [biological control organism](/usc/7/7702.md?p=2), [plant pest](/usc/7/7702.md?p=14), or [noxious weed](/usc/7/7702.md?p=10)—
    - (A) is inspected and authorized for [entry](/usc/7/7702.md?p=3) into or transit [movement](/usc/7/7702.md?p=9) through the [United States](/usc/7/7702.md?p=20); or
    - (B) is otherwise released by the [Secretary](/usc/7/7702.md?p=16) of Agriculture.
  - (3) **Exceptions—** Paragraphs [(1)](#a-1) and [(2)](#a-2) shall not apply to any [plant](/usc/7/7702.md?p=13), [plant product](/usc/7/7702.md?p=15), [biological control organism](/usc/7/7702.md?p=2), [plant pest](/usc/7/7702.md?p=14), or [noxious weed](/usc/7/7702.md?p=10) that is imported from a country or region of a country designated by the [Secretary](/usc/7/7702.md?p=16) of Agriculture, pursuant to regulations, as exempt from the requirements of such paragraphs.
- (b) **Duty of responsible parties—**
  - (1) **Notification—** The [person](/usc/7/7702.md?p=12) responsible for any [plant](/usc/7/7702.md?p=13), [plant product](/usc/7/7702.md?p=15), [biological control organism](/usc/7/7702.md?p=2), [plant pest](/usc/7/7702.md?p=14), [noxious weed](/usc/7/7702.md?p=10), [article](/usc/7/7702.md?p=1), or [means of conveyance](/usc/7/7702.md?p=8) required to have a [permit](/usc/7/7702.md?p=11) under section [7711](/usc/7/7711.md) or [7712](/usc/7/7712.md) of this title shall provide the notification described in [paragraph (3)](#b-3) as soon as possible after the arrival of the [plant](/usc/7/7702.md?p=13), [plant product](/usc/7/7702.md?p=15), [biological control organism](/usc/7/7702.md?p=2), [plant pest](/usc/7/7702.md?p=14), [noxious weed](/usc/7/7702.md?p=10), [article](/usc/7/7702.md?p=1), or [means of conveyance](/usc/7/7702.md?p=8) at a port of [entry](/usc/7/7702.md?p=3) and before the [plant](/usc/7/7702.md?p=13), [plant product](/usc/7/7702.md?p=15), [biological control organism](/usc/7/7702.md?p=2), [plant pest](/usc/7/7702.md?p=14), [noxious weed](/usc/7/7702.md?p=10), [article](/usc/7/7702.md?p=1), or [means of conveyance](/usc/7/7702.md?p=8) is moved from the port of [entry](/usc/7/7702.md?p=3).
  - (2) **Submission—** The notification shall be provided to the [Secretary](/usc/7/7702.md?p=16), or, at the [Secretary](/usc/7/7702.md?p=16)’s direction, to the proper official of the [State](/usc/7/7702.md?p=17) to which the [plant](/usc/7/7702.md?p=13), [plant product](/usc/7/7702.md?p=15), [biological control organism](/usc/7/7702.md?p=2), [plant pest](/usc/7/7702.md?p=14), [noxious weed](/usc/7/7702.md?p=10), [article](/usc/7/7702.md?p=1), or [means of conveyance](/usc/7/7702.md?p=8) is destined, or both, as the [Secretary](/usc/7/7702.md?p=16) may prescribe.
  - (3) **Elements of notification—** The notification shall consist of the following:
    - (A) The name and address of the consignee.
    - (B) The nature and quantity of the [plant](/usc/7/7702.md?p=13), [plant product](/usc/7/7702.md?p=15), [biological control organism](/usc/7/7702.md?p=2), [plant pest](/usc/7/7702.md?p=14), [noxious weed](/usc/7/7702.md?p=10), [article](/usc/7/7702.md?p=1), or [means of conveyance](/usc/7/7702.md?p=8) proposed to be moved.
    - (C) The country and locality where the [plant](/usc/7/7702.md?p=13), [plant product](/usc/7/7702.md?p=15), [biological control organism](/usc/7/7702.md?p=2), [plant pest](/usc/7/7702.md?p=14), [noxious weed](/usc/7/7702.md?p=10), [article](/usc/7/7702.md?p=1), or [means of conveyance](/usc/7/7702.md?p=8) was grown, produced, or located.
- (c) **Prohibition on movement of items without authorization—** No [person](/usc/7/7702.md?p=12) shall [move](/usc/7/7702.md?p=9) from a port of [entry](/usc/7/7702.md?p=3) or [interstate](/usc/7/7702.md?p=6) any imported [plant](/usc/7/7702.md?p=13), [plant product](/usc/7/7702.md?p=15), [biological control organism](/usc/7/7702.md?p=2), [plant pest](/usc/7/7702.md?p=14), [noxious weed](/usc/7/7702.md?p=10), [article](/usc/7/7702.md?p=1), or [means of conveyance](/usc/7/7702.md?p=8) unless the imported [plant](/usc/7/7702.md?p=13), [plant product](/usc/7/7702.md?p=15), [biological control organism](/usc/7/7702.md?p=2), [plant pest](/usc/7/7702.md?p=14), [noxious weed](/usc/7/7702.md?p=10), [article](/usc/7/7702.md?p=1), or [means of conveyance](/usc/7/7702.md?p=8)—
  - (1) is inspected and authorized for [entry](/usc/7/7702.md?p=3) into or transit [movement](/usc/7/7702.md?p=9) through the [United States](/usc/7/7702.md?p=20); or
  - (2) is otherwise released by the [Secretary](/usc/7/7702.md?p=16).
