# §7466. Permissive terms in order

- (a) **Permissive terms—** On the recommendation of the [Board](/usc/7/7462.md?p=1) and with the approval of the [Secretary](/usc/7/7462.md?p=14), an [order](/usc/7/7462.md?p=8) issued under [section 7463 of this title](/usc/7/7463.md) may include the terms and conditions specified in this section and such additional terms and conditions as the [Secretary](/usc/7/7462.md?p=14) considers necessary to effectuate the other provisions of the [order](/usc/7/7462.md?p=8) and are incidental to, and not inconsistent with, this subchapter.
- (b) **Alternative payment and reporting schedules—** The [order](/usc/7/7462.md?p=8) may authorize the [Board](/usc/7/7462.md?p=1) to designate different [handler](/usc/7/7462.md?p=4) payment and reporting schedules to recognize differences in [marketing](/usc/7/7462.md?p=7) practices and procedures.
- (c) **Working groups—** The [order](/usc/7/7462.md?p=8) may authorize the [Board](/usc/7/7462.md?p=1) to convene working groups drawn from [producers](/usc/7/7462.md?p=11), [handlers](/usc/7/7462.md?p=4), [importers](/usc/7/7462.md?p=5), [exporters](/usc/7/7462.md?p=3), or the general public and utilize the expertise of the groups to assist in the development of [research](/usc/7/7462.md?p=13) and [marketing](/usc/7/7462.md?p=7) programs for [kiwifruit](/usc/7/7462.md?p=6).
- (d) **Reserve funds—** The [order](/usc/7/7462.md?p=8) may authorize the [Board](/usc/7/7462.md?p=1) to accumulate reserve funds from assessments collected pursuant to [section 7465(b) of this title](/usc/7/7465.md?p=b) to permit an effective and continuous coordinated program of [research](/usc/7/7462.md?p=13), [promotion](/usc/7/7462.md?p=12), and [consumer information](/usc/7/7462.md?p=2) in years in which production and assessment income may be reduced, except that any reserve fund may not exceed the amount budgeted for operation of this subchapter for 1 year.
- (e) **Promotion activities outside United States—** The [order](/usc/7/7462.md?p=8) may authorize the [Board](/usc/7/7462.md?p=1) to use, with the approval of the [Secretary](/usc/7/7462.md?p=14), funds collected under [section 7465(b) of this title](/usc/7/7465.md?p=b) and funds from other sources for the development and expansion of sales in foreign [markets](/usc/7/198.md?p=1) of [kiwifruit](/usc/7/7462.md?p=6) produced in the [United States](/usc/7/7462.md?p=15).
