# §7463. Issuance of orders

- (a) **Issuance—** To effectuate the purposes of this subchapter specified in [section 7461(b) of this title](/usc/7/7461.md?p=b), the [Secretary](/usc/7/7462.md?p=14) shall issue an [order](/usc/7/7462.md?p=8) applicable to [producers](/usc/7/7462.md?p=11), [handlers](/usc/7/7462.md?p=4), and [importers](/usc/7/7462.md?p=5) of [kiwifruit](/usc/7/7462.md?p=6). Any such [order](/usc/7/7462.md?p=8) shall be national in scope. Not more than 1 [order](/usc/7/7462.md?p=8) shall be in effect under this subchapter at any 1 time.
- (b) **Procedure—**
  - (1) **Proposal for issuance of order—** Any [person](/usc/7/7462.md?p=9) that will be affected by this subchapter may request the issuance of, and submit a proposal for, an [order](/usc/7/7462.md?p=8) under this subchapter.
  - (2) **Proposed order—** Not later than 90 days after the receipt of a request and proposal for an [order](/usc/7/7462.md?p=8), the [Secretary](/usc/7/7462.md?p=14) shall publish a proposed [order](/usc/7/7462.md?p=8) and give due notice and opportunity for public comment on the proposed [order](/usc/7/7462.md?p=8).
  - (3) **Issuance of order—** After notice and opportunity for public comment are provided under [paragraph (2)](#b-2), the [Secretary](/usc/7/7462.md?p=14) shall issue an [order](/usc/7/7462.md?p=8), taking into consideration the comments received and including in the [order](/usc/7/7462.md?p=8) provisions necessary to ensure that the [order](/usc/7/7462.md?p=8) is in conformity with this subchapter.
- (c) **Amendments—** The [Secretary](/usc/7/7462.md?p=14) may amend any [order](/usc/7/7462.md?p=8) issued under this section. The provisions of this subchapter applicable to an [order](/usc/7/7462.md?p=8) shall be applicable to an amendment to an [order](/usc/7/7462.md?p=8), except that an amendment to an [order](/usc/7/7462.md?p=8) shall not require a referendum to become effective.
