# §7461. Findings and purposes

- (a) **Findings—** Congress finds that—
  - (1) domestically produced [kiwifruit](/usc/7/7462.md?p=6) are grown by many individual [producers](/usc/7/7462.md?p=11);
  - (2) virtually all domestically produced [kiwifruit](/usc/7/7462.md?p=6) are grown in the [State](/usc/7/198.md?p=5) of California, although there is potential for production in many other areas of the [United States](/usc/7/7462.md?p=15);
  - (3) [kiwifruit](/usc/7/7462.md?p=6) move in interstate and foreign commerce, and [kiwifruit](/usc/7/7462.md?p=6) that do not move in channels of commerce directly burden or affect interstate commerce;
  - (4) in recent years, large quantities of [kiwifruit](/usc/7/7462.md?p=6) have been imported into the [United States](/usc/7/7462.md?p=15);
  - (5) the maintenance and expansion of existing domestic and foreign [markets](/usc/7/198.md?p=1) for [kiwifruit](/usc/7/7462.md?p=6), and the development of additional and improved [markets](/usc/7/198.md?p=1) for [kiwifruit](/usc/7/7462.md?p=6), are vital to the welfare of [kiwifruit](/usc/7/7462.md?p=6) [producers](/usc/7/7462.md?p=11) and other [persons](/usc/7/7462.md?p=9) concerned with producing, [marketing](/usc/7/7462.md?p=7), and [processing](/usc/7/7462.md?p=10) [kiwifruit](/usc/7/7462.md?p=6);
  - (6) a coordinated program of [research](/usc/7/7462.md?p=13), [promotion](/usc/7/7462.md?p=12), and [consumer information](/usc/7/7462.md?p=2) regarding [kiwifruit](/usc/7/7462.md?p=6) is necessary for the maintenance and development of the [markets](/usc/7/198.md?p=1); and
  - (7) [kiwifruit](/usc/7/7462.md?p=6) [producers](/usc/7/7462.md?p=11), [handlers](/usc/7/7462.md?p=4), and [importers](/usc/7/7462.md?p=5) are unable to implement and finance such a program without cooperative action.
- (b) **Purposes—** The purposes of this subchapter are—
  - (1) to authorize the establishment of an orderly procedure for the development and financing (through an assessment) of an effective and coordinated program of [research](/usc/7/7462.md?p=13), [promotion](/usc/7/7462.md?p=12), and [consumer information](/usc/7/7462.md?p=2) regarding [kiwifruit](/usc/7/7462.md?p=6);
  - (2) to use the program to strengthen the position of the [kiwifruit](/usc/7/7462.md?p=6) industry in domestic and foreign [markets](/usc/7/198.md?p=1) and maintain, develop, and expand [markets](/usc/7/198.md?p=1) for [kiwifruit](/usc/7/7462.md?p=6); and
  - (3) to treat domestically produced [kiwifruit](/usc/7/7462.md?p=6) and imported [kiwifruit](/usc/7/7462.md?p=6) equitably.
