# §7443. Issuance and amendment of orders

- (a) **In general—** Subject to [subsection (b)](#b), the [Secretary](/usc/7/7412.md?p=14) shall issue 1 or more [orders](/usc/7/7412.md?p=9) under this subchapter applicable to [producers](/usc/7/7412.md?p=11) and [first purchasers](/usc/7/7442.md?p=8) of [canola](/usc/7/7442.md?p=2), [rapeseed](/usc/7/7442.md?p=2), or [canola or rapeseed products](/usc/7/7442.md?p=3). The [order](/usc/7/7412.md?p=9) shall be national in scope. Not more than 1 [order](/usc/7/7412.md?p=9) shall be in effect under this subchapter at any 1 time.
- (b) **Procedure—**
  - (1) **Proposal or request for issuance—** The [Secretary](/usc/7/7412.md?p=14) may propose the issuance of an [order](/usc/7/7412.md?p=9) under this subchapter, or an association of [canola](/usc/7/7442.md?p=2) and [rapeseed](/usc/7/7442.md?p=2) [producers](/usc/7/7412.md?p=11) or any other [person](/usc/7/7412.md?p=10) that would be affected by an [order](/usc/7/7412.md?p=9) issued pursuant to this subchapter may request the issuance of, and submit a proposal for, an [order](/usc/7/7412.md?p=9).
  - (2) **Notice and comment concerning proposed order—** Not later than 60 days after the receipt of a request and proposal for an [order](/usc/7/7412.md?p=9) pursuant to [paragraph (1)](#b-1), or whenever the [Secretary](/usc/7/7412.md?p=14) determines to propose an [order](/usc/7/7412.md?p=9), the [Secretary](/usc/7/7412.md?p=14) shall publish a proposed [order](/usc/7/7412.md?p=9) and give due notice and opportunity for public comment on the proposed [order](/usc/7/7412.md?p=9).
  - (3) **Issuance of order—** After notice and opportunity for public comment are given as provided in [paragraph (2)](#b-2), the [Secretary](/usc/7/7412.md?p=14) shall issue an [order](/usc/7/7412.md?p=9), taking into consideration the comments received and including in the [order](/usc/7/7412.md?p=9) provisions necessary to ensure that the [order](/usc/7/7412.md?p=9) is in conformity with the requirements of this subchapter. The [order](/usc/7/7412.md?p=9) shall be issued and become effective not later than 180 days following publication of the proposed [order](/usc/7/7412.md?p=9).
- (c) **Amendments—** The [Secretary](/usc/7/7412.md?p=14) may amend an [order](/usc/7/7412.md?p=9) issued under this section.
