# §7421. Suspension or termination

- (a) **Mandatory suspension or termination—** The [Secretary](/usc/7/7412.md?p=14) shall [suspend](/usc/7/7412.md?p=16) or [terminate](/usc/7/7412.md?p=17) an [order](/usc/7/7412.md?p=9) or a provision of an [order](/usc/7/7412.md?p=9) if the [Secretary](/usc/7/7412.md?p=14) finds that an [order](/usc/7/7412.md?p=9) or a provision of an [order](/usc/7/7412.md?p=9) obstructs or does not tend to effectuate the purpose of this subchapter, or if the [Secretary](/usc/7/7412.md?p=14) determines that the [order](/usc/7/7412.md?p=9) or a provision of an [order](/usc/7/7412.md?p=9) is not favored by [persons](/usc/7/7412.md?p=10) voting in a referendum conducted under [section 7417 of this title](/usc/7/7417.md).
- (b) **Implementation of suspension or termination—** If, as a result of a referendum conducted under [section 7417 of this title](/usc/7/7417.md), the [Secretary](/usc/7/7412.md?p=14) determines that an [order](/usc/7/7412.md?p=9) is not approved, the [Secretary](/usc/7/7412.md?p=14) shall—
  - (1) not later than 180 days after making the determination, [suspend](/usc/7/7412.md?p=16) or [terminate](/usc/7/7412.md?p=17), as the case may be, collection of assessments under the [order](/usc/7/7412.md?p=9); and
  - (2) as soon as practicable, [suspend](/usc/7/7412.md?p=16) or [terminate](/usc/7/7412.md?p=17), as the case may be, activities under the [order](/usc/7/7412.md?p=9) in an orderly manner.
