# §7413. Issuance of orders

- (a) **Issuance authorized—**
  - (1) **In general—** To effectuate the purpose of this subchapter, the [Secretary](/usc/7/7412.md?p=14) may issue, and amend from time to time, [orders](/usc/7/7412.md?p=9) applicable to—
    - (A) the [producers](/usc/7/7412.md?p=11) of an [agricultural commodity](/usc/7/7412.md?p=1);
    - (B) the [first handlers](/usc/7/7412.md?p=5) of the [agricultural commodity](/usc/7/7412.md?p=1) and other [persons](/usc/7/7412.md?p=10) in the marketing chain as appropriate; and
    - (C) the [importers](/usc/7/7412.md?p=6) of the [agricultural commodity](/usc/7/7412.md?p=1), if imports of the [agricultural commodity](/usc/7/7412.md?p=1) are subject to assessment under [section 7415(f) of this title](/usc/7/7415.md?p=f).
  - (2) **National scope—** Each [order](/usc/7/7412.md?p=9) issued under this section shall be national in scope.
- (b) **Procedure for issuance—**
  - (1) **Development or receipt of proposed order—** A proposed [order](/usc/7/7412.md?p=9) with respect to an [agricultural commodity](/usc/7/7412.md?p=1) may be—
    - (A) prepared by the [Secretary](/usc/7/7412.md?p=14) at any time; or
    - (B) submitted to the [Secretary](/usc/7/7412.md?p=14) by—
      - (i) an association of [producers](/usc/7/7412.md?p=11) of the [agricultural commodity](/usc/7/7412.md?p=1); or
      - (ii) any other [person](/usc/7/7412.md?p=10) that may be affected by the issuance of an [order](/usc/7/7412.md?p=9) with respect to the [agricultural commodity](/usc/7/7412.md?p=1).
  - (2) **Consideration of proposed order—** If the [Secretary](/usc/7/7412.md?p=14) determines that a proposed [order](/usc/7/7412.md?p=9) is consistent with and will effectuate the purpose of this subchapter, the [Secretary](/usc/7/7412.md?p=14) shall publish the proposed [order](/usc/7/7412.md?p=9) in the Federal Register and give due notice and opportunity for public comment on the proposed [order](/usc/7/7412.md?p=9).
  - (3) **Existence of other orders—** In deciding whether a proposal for an [order](/usc/7/7412.md?p=9) is consistent with and will effectuate the purpose of this subchapter, the [Secretary](/usc/7/7412.md?p=14) may consider the existence of other Federal [promotion](/usc/7/7412.md?p=12), [research](/usc/7/7412.md?p=13), and [information](/usc/7/7412.md?p=7) programs or [orders](/usc/7/7412.md?p=9) issued or developed pursuant to any other law.
  - (4) **Preparation of final order—** After notice and opportunity for public comment under [paragraph (2)](#b-2) regarding a proposed [order](/usc/7/7412.md?p=9), the [Secretary](/usc/7/7412.md?p=14) shall take into consideration the comments received in preparing a final [order](/usc/7/7412.md?p=9). The [Secretary](/usc/7/7412.md?p=14) shall ensure that the final [order](/usc/7/7412.md?p=9) is in conformity with the terms, conditions, and requirements of this subchapter.
- (c) **Issuance and effective date—** If the [Secretary](/usc/7/7412.md?p=14) determines that the final [order](/usc/7/7412.md?p=9) developed with respect to an [agricultural commodity](/usc/7/7412.md?p=1) is consistent with and will effectuate the purpose of this subchapter, the [Secretary](/usc/7/7412.md?p=14) shall issue the final [order](/usc/7/7412.md?p=9). Except in the case of an [order](/usc/7/7412.md?p=9) for which an initial referendum is conducted under [section 7417(a) of this title](/usc/7/7417.md?p=a), the final [order](/usc/7/7412.md?p=9) shall be issued and become effective not later than 270 days after the date of publication of the proposed [order](/usc/7/7412.md?p=9) that was the basis for the final [order](/usc/7/7412.md?p=9).
- (d) **Amendments—** From time to time the [Secretary](/usc/7/7412.md?p=14) may amend any [order](/usc/7/7412.md?p=9), consistent with the requirements of [section 7422 of this title](/usc/7/7422.md).
