# §6303. Issuance and amendment of orders

- (a) **In general—** To effectuate the declared policy of [section 6301(b) of this title](/usc/7/6301.md?p=b), the [Secretary](/usc/7/6302.md?p=16), subject to the procedures provided in [subsection (b)](#b), shall issue [orders](/usc/7/6302.md?p=10) under this chapter applicable to [producers](/usc/7/6302.md?p=12) and [first purchasers](/usc/7/6302.md?p=6) of [soybeans](/usc/7/6302.md?p=18). Any such [order](/usc/7/6302.md?p=10) shall be national in scope, and not more than one [order](/usc/7/6302.md?p=10) shall be in effect under this chapter at any one time.
- (b) **Procedure—**
  - (1) **Proposal or request for issuance—** The [Secretary](/usc/7/6302.md?p=16) may propose the issuance of an [order](/usc/7/6302.md?p=10) under this chapter, or an association of soybean [producers](/usc/7/6302.md?p=12) or any other [person](/usc/7/6302.md?p=11) that would be affected by an [order](/usc/7/6302.md?p=10) issued pursuant to this chapter may request the issuance of, and submit a proposal for, such an [order](/usc/7/6302.md?p=10).
  - (2) **Notice and comment concerning proposed order—** Not later than 30 days after the receipt of a request and proposal for an [order](/usc/7/6302.md?p=10) pursuant to [paragraph (1)](#b-1), or whenever the [Secretary](/usc/7/6302.md?p=16) determines to propose an [order](/usc/7/6302.md?p=10), the [Secretary](/usc/7/6302.md?p=16) shall publish a proposed [order](/usc/7/6302.md?p=10) and give due notice and opportunity for public comment on the proposed [order](/usc/7/6302.md?p=10).
  - (3) **Issuance of order—** After notice and opportunity for public comment are given as provided in [paragraph (2)](#b-2), the [Secretary](/usc/7/6302.md?p=16) shall issue an [order](/usc/7/6302.md?p=10), taking into consideration the comments received and including in the [order](/usc/7/6302.md?p=10) provisions necessary to ensure that the [order](/usc/7/6302.md?p=10) is in conformity with the requirements under this chapter. Such [order](/usc/7/6302.md?p=10) shall be issued and become effective not later than 180 days following publication of the proposed [order](/usc/7/6302.md?p=10).
- (c) **Amendments—** The [Secretary](/usc/7/6302.md?p=16), from time to time, may amend any [order](/usc/7/6302.md?p=10) issued under this section. The provisions of this chapter applicable to [orders](/usc/7/6302.md?p=10) shall be applicable to amendments to [orders](/usc/7/6302.md?p=10).
