# §6001. Findings and declaration of policy

- (a) **Findings—** Congress finds that—
  - (1) [pecans](/usc/7/6002.md?p=16) are a native American nut that is an important food, and is a valuable part of the human diet;
  - (2) the production of [pecans](/usc/7/6002.md?p=16) plays a significant role in the economy of the [United States](/usc/7/6002.md?p=26) in that [pecans](/usc/7/6002.md?p=16) are produced by thousands of [pecan](/usc/7/6002.md?p=16) producers, shelled and processed by numerous [shellers](/usc/7/6002.md?p=24) and processors, and [pecans](/usc/7/6002.md?p=16) produced in the [United States](/usc/7/6002.md?p=26) are consumed by millions of people throughout the [United States](/usc/7/6002.md?p=26) and foreign countries;
  - (3) [pecans](/usc/7/6002.md?p=16) must be high quality, readily available, handled properly, and marketed efficiently to ensure that consumers have an adequate supply of [pecans](/usc/7/6002.md?p=16);
  - (4) the maintenance and expansion of existing [markets](/usc/7/198.md?p=1) and development of new [markets](/usc/7/198.md?p=1) for [pecans](/usc/7/6002.md?p=16) are vital to the welfare of [pecan](/usc/7/6002.md?p=16) producers and those concerned with marketing, using, and producing [pecans](/usc/7/6002.md?p=16), as well as to the general economy of the [United States](/usc/7/6002.md?p=26), and necessary to ensure the ready availability and efficient marketing of [pecans](/usc/7/6002.md?p=16);
  - (5) there exist established [State](/usc/7/6002.md?p=25) organizations conducting [pecan](/usc/7/6002.md?p=16) [promotion](/usc/7/6002.md?p=19), [research](/usc/7/6002.md?p=20), and industry and consumer education programs that are invaluable to the efforts of promoting the consumption of [pecans](/usc/7/6002.md?p=16);
  - (6) the cooperative development, financing, and implementation of a coordinated national program of [pecan](/usc/7/6002.md?p=16) [promotion](/usc/7/6002.md?p=19), [research](/usc/7/6002.md?p=20), [industry information](/usc/7/6002.md?p=12), and [consumer information](/usc/7/6002.md?p=4) are necessary to maintain and expand existing [markets](/usc/7/198.md?p=1) and develop new [markets](/usc/7/198.md?p=1) for [pecans](/usc/7/6002.md?p=16); and
  - (7) [pecans](/usc/7/6002.md?p=16) move in interstate and foreign [commerce](/usc/7/6002.md?p=2), and [pecans](/usc/7/6002.md?p=16) that do not move in such channels of [commerce](/usc/7/6002.md?p=2) directly burden or affect interstate [commerce](/usc/7/6002.md?p=2) in [pecans](/usc/7/6002.md?p=16).
- (b) **Policy—** It is declared to be the policy of Congress that it is in the public interest to authorize the establishment, through the exercise of the powers provided in this chapter, of an orderly procedure for developing, financing (through adequate assessments on [pecans](/usc/7/6002.md?p=16) produced or imported into the [United States](/usc/7/6002.md?p=26)), and carrying out an effective, continuous, coordinated program of [promotion](/usc/7/6002.md?p=19), [research](/usc/7/6002.md?p=20), [industry information](/usc/7/6002.md?p=12), and [consumer information](/usc/7/6002.md?p=4) designed to—
  - (1) strengthen the [pecan](/usc/7/6002.md?p=16) industry’s position in the marketplace;
  - (2) maintain and expand existing domestic and foreign [markets](/usc/7/198.md?p=1) and uses for [pecans](/usc/7/6002.md?p=16); and
  - (3) develop new [markets](/usc/7/198.md?p=1) and uses for [pecans](/usc/7/6002.md?p=16).
- (c) **Construction—** Nothing in this chapter may be construed to provide for the control of production or otherwise limit the right of any [person](/usc/7/6002.md?p=17) to produce [pecans](/usc/7/6002.md?p=16).

### Short Title

Pub. L. 101–624, title XIX, § 1901, Nov. 28, 1990, 104 Stat. 3838, as amended by Pub. L. 102–237, title VIII, § 801, Dec. 13, 1991, 105 Stat. 1882, provided that: “This title [enacting this chapter and chapters 90 to 93 of this title and sections 2109, 2278, and 4610a of this title, amending sections 1787, 2101, 2106 to 2108, 2110, 2116, 2611 to 2614, 2617 to 2619, 2622 to 2624, 4602, 4606, 4608, and 4612 of this title, and enacting provisions set out as notes under sections 2101, 2611, 2625, 4601, and 4603 of this title] may be cited as the ‘Agricultural Promotion Programs Act of 1990’.”

Pub. L. 101–624, title XIX, § 1905, Nov. 28, 1990, 104 Stat. 3838, provided that: “This subtitle [subtitle A (§§ 1905–1918) of title XIX of Pub. L. 101–624, enacting this chapter] may be cited as the ‘Pecan Promotion and Research Act of 1990’.”
