# §4312. Refund of assessments


Notwithstanding any other provisions of this chapter, any [producer](/usc/7/4302.md?p=13) or [importer](/usc/7/4302.md?p=15) who pays an assessment shall have the right to demand and receive from the [Floraboard](/usc/7/4302.md?p=14) a refund of such assessment: Provided, That such demand shall be made by such [producer](/usc/7/4302.md?p=13) or [importer](/usc/7/4302.md?p=15) in accordance with regulations and on a form and within a time period prescribed by the [Floraboard](/usc/7/4302.md?p=14) and approved by the [Secretary](/usc/7/4302.md?p=1), but in no event more than sixty days after the end of the month in which the assessment was paid. Such refund shall be made not later than sixty days after submission of proof satisfactory to the [Floraboard](/usc/7/4302.md?p=14) that the [producer](/usc/7/4302.md?p=13) or [importer](/usc/7/4302.md?p=15) paid the assessment for which refund is sought.
