# §2561. Remedy for infringement of plant variety protection


An owner shall have remedy by civil action for infringement of plant [variety](/usc/7/2401.md?p=a-10) protection under [section 2541 of this title](/usc/7/2541.md). If a [variety](/usc/7/2401.md?p=a-10) is sold under the name of a [variety](/usc/7/2401.md?p=a-10) shown in a certificate, there is a prima facie presumption that it is the same [variety](/usc/7/2401.md?p=a-10).
