# §2441. Examination of application


The [Secretary](/usc/7/499a.md?p=b-2) shall cause an examination to be made of the application and if on such examination it is determined that the applicant is entitled to plant [variety](/usc/7/2401.md?p=a-10) protection under the law, the [Secretary](/usc/7/499a.md?p=b-2) shall issue a notice of allowance of plant [variety](/usc/7/2401.md?p=a-10) protection therefor as hereinafter provided.
