# §2424. Death or incapacity of breeder


Legal representatives of deceased [breeders](/usc/7/2401.md?p=a-3) and of those under legal incapacity may make application for plant [variety](/usc/7/2401.md?p=a-10) protection upon compliance with the requirements and on the same terms and conditions applicable to the [breeder](/usc/7/2401.md?p=a-3) or the successor in interest of the [breeder](/usc/7/2401.md?p=a-3).
