# §1471c. Eligible producers

- (a) **Qualifying livestock producers—**
  - (1) If the [Secretary](/usc/7/499a.md?p=b-2) determines that a [livestock](/usc/7/1471.md?p=2) emergency exists in a [State](/usc/7/1471.md?p=3), county, or [area](/usc/7/1471.md?p=5), qualifying [livestock producers](/usc/7/1471.md?p=1) located in such [State](/usc/7/1471.md?p=3), county, or [area](/usc/7/1471.md?p=5), or in a contiguous county as provided for in [section 1471a(b) of this title](/usc/7/1471a.md?p=b), shall be eligible (under application procedures established by the [Secretary](/usc/7/499a.md?p=b-2)) for emergency [feed](/usc/7/1471.md?p=4) assistance under this subchapter in accordance with this subsection.
  - (2) For the purposes of this subsection, a “qualifying [livestock producer](/usc/7/1471.md?p=1)” is a [livestock producer](/usc/7/1471.md?p=1) who has suffered a substantial loss in [feed](/usc/7/1471.md?p=4) normally produced on the farm for such producer’s [livestock](/usc/7/1471.md?p=2) as a result of the [livestock](/usc/7/1471.md?p=2) emergency and, as a result, does not have sufficient [feed](/usc/7/1471.md?p=4) that has adequate nutritive value and is suitable for each of such producer’s particular types of [livestock](/usc/7/1471.md?p=2) (as of the date of the request, or initiation of consideration, for a determination of a [livestock](/usc/7/1471.md?p=2) emergency under [section 1471b of this title](/usc/7/1471b.md)) for the estimated duration of the emergency.
  - (3) Each qualifying [livestock producer](/usc/7/1471.md?p=1) shall be eligible for emergency [feed](/usc/7/1471.md?p=4) assistance under the programs specified in [section 1471d(a) of this title](/usc/7/1471d.md?p=a) that is made available where the producer is located in quantities sufficient to meet such [feed](/usc/7/1471.md?p=4) deficiency with respect to the producer’s [livestock](/usc/7/1471.md?p=2) normally fed with [feed](/usc/7/1471.md?p=4) produced by the producer.
- (b) **Availability of additional assistance—** Each [livestock producer](/usc/7/1471.md?p=1) in such [State](/usc/7/1471.md?p=3), county, or [area](/usc/7/1471.md?p=5), or in a contiguous county as provided for in [section 1471a(b) of this title](/usc/7/1471a.md?p=b), regardless of whether the producer qualifies for assistance under [subsection (a)](#a), shall be eligible for emergency assistance under the programs specified in [section 1471e of this title](/usc/7/1471e.md) that are made available where the producer is located.
- (c) **Program participation option—** Any [livestock producer](/usc/7/1471.md?p=1), located in a county or [area](/usc/7/1471.md?p=5) in which benefits under the emergency [feed](/usc/7/1471.md?p=4) program or the emergency [feed](/usc/7/1471.md?p=4) assistance program were made available due to the drought or related condition in 1988 prior to the effective date of this subchapter, who qualifies for assistance under such pre-existing programs shall be eligible for assistance for such drought or related conditions as prescribed in [subsection (a)](#a) or, at the producer’s option, for assistance under such pre-existing programs.

### Inapplicability of Section

Section inapplicable to 2014 through 2018 crops of covered commodities, cotton, and sugar and inapplicable to milk during period beginning Feb. 7, 2014, through Dec. 31, 2018, see section 9092(b)(12) of this title.

Section inapplicable to 2008 through 2012 crops of covered commodities, peanuts, and sugar and inapplicable to milk during period beginning June 18, 2008, through Dec. 31, 2012, see section 8782(b)(12) of this title.
