# §136e. Registration of establishments

- (a) **Requirement—** No [person](/usc/7/136.md?p=s) shall [produce](/usc/7/136.md?p=w) any [pesticide](/usc/7/136.md?p=u) subject to this subchapter or [active ingredient](/usc/7/136.md?p=a) used in producing a [pesticide](/usc/7/136.md?p=u) subject to this subchapter in any [State](/usc/7/136.md?p=aa) unless the [establishment](/usc/7/136.md?p=dd) in which it is produced is registered with the [Administrator](/usc/7/136.md?p=b). The application for [registration](/usc/7/136.md?p=z) of any [establishment](/usc/7/136.md?p=dd) shall include the name and address of the [establishment](/usc/7/136.md?p=dd) and of the [producer](/usc/7/136.md?p=w) who operates such [establishment](/usc/7/136.md?p=dd).
- (b) **Registration—** Whenever the [Administrator](/usc/7/136.md?p=b) receives an application under [subsection (a)](#a), the [Administrator](/usc/7/136.md?p=b) shall register the [establishment](/usc/7/136.md?p=dd) and assign it an [establishment](/usc/7/136.md?p=dd) number.
- (c) **Information required—**
  - (1) Any [producer](/usc/7/136.md?p=w) operating an [establishment](/usc/7/136.md?p=dd) registered under this section shall inform the [Administrator](/usc/7/136.md?p=b) within 30 days after it is registered of the types and amounts of [pesticides](/usc/7/136.md?p=u) and, if applicable, [active ingredients](/usc/7/136.md?p=a) used in producing [pesticides](/usc/7/136.md?p=u)—
    - (A) which the [producer](/usc/7/136.md?p=w) is currently producing;
    - (B) which the [producer](/usc/7/136.md?p=w) has produced during the past year; and
    - (C) which the [producer](/usc/7/136.md?p=w) has sold or distributed during the past year.

    The information required by this paragraph shall be kept current and submitted to the [Administrator](/usc/7/136.md?p=b) annually as required under such regulations as the [Administrator](/usc/7/136.md?p=b) may prescribe.

  - (2) Any such [producer](/usc/7/136.md?p=w) shall, upon the request of the [Administrator](/usc/7/136.md?p=b) for the purpose of issuing a stop sale order pursuant to [section 136k of this title](/usc/7/136k.md), inform the [Administrator](/usc/7/136.md?p=b) of the name and address of any recipient of any [pesticide](/usc/7/136.md?p=u) produced in any registered [establishment](/usc/7/136.md?p=dd) which the [producer](/usc/7/136.md?p=w) operates.
- (d) **Confidential records and information—** Any information submitted to the [Administrator](/usc/7/136.md?p=b) pursuant to [subsection (c)](#c) other than the names of the [pesticides](/usc/7/136.md?p=u) or [active ingredients](/usc/7/136.md?p=a) used in producing [pesticides](/usc/7/136.md?p=u) produced, sold, or distributed at an [establishment](/usc/7/136.md?p=dd) shall be considered confidential and shall be subject to the provisions of [section 136h of this title](/usc/7/136h.md).

1991—Subsec. (b). Pub. L. 102–237, § 1006(b)(1), substituted “the Administrator” for “he” before “shall”.

1978—Subsec. (a). Pub. L. 95–396, § 13(1), made requirement of registration applicable to production of active ingredient used in producing a pesticide subject to this subchapter.

Subsec. (c)(1). Pub. L. 95–396, § 13(2), required information pertaining to types and amounts of active ingredients used in producing pesticides where applicable.

Subsec. (d). Pub. L. 95–396, § 13(3), considered names of pesticides or active ingredients used in producing pesticides produced, sold, or distributed at an establishment as not being confidential information.
