# §677d. Notification and reporting

- (a) **Notification—** Upon a [declaration](/usc/6/677a.md?p=2) or [renewal](/usc/6/677a.md?p=7), the [Secretary](/usc/6/641.md?p=3) shall immediately notify the National Cyber [Director](/usc/6/650.md?p=10) and [appropriate congressional committees](/usc/6/650.md?p=2) and include in the notification—
  - (1) an estimation of the planned duration of the [declaration](/usc/6/677a.md?p=2);
  - (2) with respect to a notification of a [declaration](/usc/6/677a.md?p=2), the reason for the [declaration](/usc/6/677a.md?p=2), including information relating to the specific [significant incident](/usc/6/677a.md?p=8) or imminent specific [significant incident](/usc/6/677a.md?p=8), including—
    - (A) the operational or mission impact or anticipated impact of the specific [significant incident](/usc/6/677a.md?p=8) on Federal and non-[Federal entities](/usc/6/681.md?p=7);
    - (B) if known, the perpetrator of the specific [significant incident](/usc/6/677a.md?p=8); and
    - (C) the scope of the Federal and non-[Federal entities](/usc/6/681.md?p=7) impacted or anticipated to be impacted by the specific [significant incident](/usc/6/677a.md?p=8);
  - (3) with respect to a notification of a [renewal](/usc/6/677a.md?p=7), the reason for the [renewal](/usc/6/677a.md?p=7);
  - (4) justification as to why available resources, other than the [Fund](/usc/6/677a.md?p=5), are insufficient to respond to or mitigate the specific [significant incident](/usc/6/677a.md?p=8); and
  - (5) a description of the coordination activities described in [section 677b(b) of this title](/usc/6/677b.md?p=b) that the [Secretary](/usc/6/641.md?p=3) anticipates the [Director](/usc/6/650.md?p=10) to perform.
- (b) **Report to Congress—** Not later than 180 days after the date of a [declaration](/usc/6/677a.md?p=2) or [renewal](/usc/6/677a.md?p=7), the [Secretary](/usc/6/641.md?p=3) shall submit to the [appropriate congressional committees](/usc/6/650.md?p=2) a report that includes—
  - (1) the reason for the [declaration](/usc/6/677a.md?p=2) or [renewal](/usc/6/677a.md?p=7), including information and intelligence relating to the specific [significant incident](/usc/6/677a.md?p=8) that led to the [declaration](/usc/6/677a.md?p=2) or [renewal](/usc/6/677a.md?p=7);
  - (2) the use of any [funds](/usc/6/677a.md?p=5) from the [Fund](/usc/6/677a.md?p=5) for the purpose of responding to the [incident](/usc/6/650.md?p=12) or threat described in [paragraph (1)](#b-1);
  - (3) a description of the actions, initiatives, and projects undertaken by the [Department](/usc/6/641.md?p=1) and [State](/usc/6/101.md?p=17) and [local governments](/usc/6/101.md?p=13) and public and private [entities](/usc/6/301c.md?p=2) in responding to and recovering from the specific [significant incident](/usc/6/677a.md?p=8) described in [paragraph (1)](#b-1);
  - (4) an accounting of the specific obligations and outlays of the [Fund](/usc/6/677a.md?p=5); and
  - (5) an analysis of—
    - (A) the impact of the specific [significant incident](/usc/6/677a.md?p=8) described in [paragraph (1)](#b-1) on Federal and non-[Federal entities](/usc/6/681.md?p=7);
    - (B) the impact of the [declaration](/usc/6/677a.md?p=2) or [renewal](/usc/6/677a.md?p=7) on the response to, and recovery from, the specific [significant incident](/usc/6/677a.md?p=8) described in [paragraph (1)](#b-1); and
    - (C) the impact of the [funds](/usc/6/677a.md?p=5) made available from the [Fund](/usc/6/677a.md?p=5) as a result of the [declaration](/usc/6/677a.md?p=2) or [renewal](/usc/6/677a.md?p=7) on the recovery from, and response to, the specific [significant incident](/usc/6/677a.md?p=8) described in [paragraph (1)](#b-1).
- (c) **Classification—** Each notification made under [subsection (a)](#a) and each report submitted under [subsection (b)](#b)—
  - (1) shall be in an unclassified form with appropriate markings to indicate information that is exempt from disclosure under [section 552 of title 5](/usc/5/552.md) (commonly known as the “Freedom of Information Act”); and
  - (2) may include a classified annex.
- (d) **Consolidated report—** The [Secretary](/usc/6/641.md?p=3) shall not be required to submit multiple reports under [subsection (b)](#b) for multiple [declarations](/usc/6/677a.md?p=2) or [renewals](/usc/6/677a.md?p=7) if the [Secretary](/usc/6/641.md?p=3) determines that the [declarations](/usc/6/677a.md?p=2) or [renewals](/usc/6/677a.md?p=7) substantively relate to the same specific [significant incident](/usc/6/677a.md?p=8).
- (e) **Exemption—** The requirements of subchapter I of [chapter 35](/usc/44/chch35.md) of title 44 (commonly known as the “Paperwork Reduction Act”) shall not apply to the [voluntary](/usc/6/671.md?p=6-A) collection of information by the [Department](/usc/6/641.md?p=1) during an investigation of, a response to, or an immediate post-response review of, the specific [significant incident](/usc/6/677a.md?p=8) leading to a [declaration](/usc/6/677a.md?p=2) or [renewal](/usc/6/677a.md?p=7).
