# §607. Terrorism prevention

- (a) **Law enforcement terrorism prevention program—**
  - (1) **In general—** The [Administrator](/usc/6/601.md?p=1) shall ensure that not less than 25 percent of the total combined [funds](/usc/6/677a.md?p=5) appropriated for grants under sections [604](/usc/6/604.md) and [605](/usc/6/605.md) of this title is used for law enforcement [terrorism](/usc/6/101.md?p=18) prevention activities.
  - (2) **Law enforcement terrorism prevention activities—** Law enforcement [terrorism](/usc/6/101.md?p=18) prevention activities include—
    - (A) information sharing and analysis;
    - (B) target hardening;
    - (C) threat recognition;
    - (D) terrorist interdiction;
    - (E) training exercises to enhance preparedness for and response to mass casualty and active shooter [incidents](/usc/6/677a.md?p=6) and security events at public locations, including airports and mass transit systems;
    - (F) overtime expenses consistent with a [State](/usc/6/101.md?p=17) [homeland](/usc/6/101.md?p=1) security plan, including for the provision of enhanced law enforcement operations in support of [Federal agencies](/usc/6/677a.md?p=4), including for increased border security and border crossing enforcement;
    - (G) establishing, enhancing, and staffing with appropriately qualified [personnel](/usc/6/101.md?p=15) [State](/usc/6/101.md?p=17), local, and regional fusion [centers](/usc/6/681.md?p=1) that comply with the guidelines established under [section 124h(i) of this title](/usc/6/124h.md?p=i);
    - (H) paying salaries and benefits for [personnel](/usc/6/101.md?p=15), including individuals employed by the grant recipient on the date of the relevant grant application, to serve as [qualified intelligence analysts](/usc/6/601.md?p=12);
    - (I) any other activity permitted under the Fiscal Year 2007 Program Guidance of the [Department](/usc/6/101.md?p=5) for the Law Enforcement [Terrorism](/usc/6/101.md?p=18) Prevention Program; and
    - (J) any other [terrorism](/usc/6/101.md?p=18) prevention activity authorized by the [Administrator](/usc/6/601.md?p=1).
  - (3) **Participation of underrepresented communities in fusion centers—** The [Administrator](/usc/6/601.md?p=1) shall ensure that grant [funds](/usc/6/677a.md?p=5) described in [paragraph (1)](#a-1) are used to support the participation, as appropriate, of law enforcement and other [emergency response providers](/usc/6/101.md?p=6) from rural and other underrepresented communities at risk from acts of [terrorism](/usc/6/101.md?p=18) in fusion [centers](/usc/6/681.md?p=1).
- (b) **Office for State and Local Law Enforcement—**
  - (1) **Establishment—** There is established in the Policy Directorate of the [Department](/usc/6/101.md?p=5) an Office for [State](/usc/6/101.md?p=17) and Local Law Enforcement, which shall be headed by an Assistant [Secretary](/usc/6/101.md?p=16) for [State](/usc/6/101.md?p=17) and Local Law Enforcement.
  - (2) **Qualifications—** The Assistant [Secretary](/usc/6/101.md?p=16) for [State](/usc/6/101.md?p=17) and Local Law Enforcement shall have an appropriate background with experience in law enforcement, intelligence, and other counterterrorism [functions](/usc/6/101.md?p=9).
  - (3) **Assignment of personnel—** The [Secretary](/usc/6/101.md?p=16) shall assign to the Office for [State](/usc/6/101.md?p=17) and Local Law Enforcement permanent staff and, as appropriate and consistent with sections [316(c)(2)](/usc/6/316.md?p=c-2), [381](/usc/6/381.md), and [468(d)](/usc/6/468.md?p=d) of this title, other appropriate [personnel](/usc/6/101.md?p=15) detailed from other components of the [Department](/usc/6/101.md?p=5) to carry out the responsibilities under this subsection.
  - (4) **Responsibilities—** The Assistant [Secretary](/usc/6/101.md?p=16) for [State](/usc/6/101.md?p=17) and Local Law Enforcement shall—
    - (A) lead the coordination of [Department](/usc/6/101.md?p=5)-wide policies relating to the role of [State](/usc/6/101.md?p=17) and local law enforcement in preventing, preparing for, protecting against, and responding to natural disasters, acts of [terrorism](/usc/6/101.md?p=18), and other man-made disasters within the [United States](/usc/6/101.md?p=19-A);
    - (B) serve as a liaison between [State](/usc/6/101.md?p=17), local, and tribal law enforcement [agencies](/usc/6/671.md?p=1) and the [Department](/usc/6/101.md?p=5);
    - (C) coordinate with the Office of Intelligence and Analysis to ensure the intelligence and information sharing requirements of [State](/usc/6/101.md?p=17), local, and tribal law enforcement [agencies](/usc/6/671.md?p=1) are being addressed;
    - (D) work with the [Administrator](/usc/6/601.md?p=1) to ensure that law enforcement and [terrorism](/usc/6/101.md?p=18)-focused grants to [State](/usc/6/101.md?p=17), local, and [tribal government](/usc/6/601.md?p=14) [agencies](/usc/6/671.md?p=1), including grants under sections [604](/usc/6/604.md) and [605](/usc/6/605.md) of this title, the Commercial Equipment Direct Assistance Program, and other grants administered by the [Department](/usc/6/101.md?p=5) to support fusion [centers](/usc/6/681.md?p=1) and law enforcement-oriented programs, are appropriately focused on [terrorism](/usc/6/101.md?p=18) prevention activities;
    - (E) coordinate with the Science and Technology Directorate, the Federal [Emergency Management](/usc/6/701.md?p=7) [Agency](/usc/6/671.md?p=1), the [Department](/usc/6/101.md?p=5) of Justice, the National Institute of Justice, law enforcement organizations, and other appropriate [entities](/usc/6/301c.md?p=2) to support the development, promulgation, and updating, as necessary, of national [voluntary](/usc/6/671.md?p=6-A) consensus standards for training and personal protective equipment to be used in a tactical environment by law enforcement officers; and
    - (F) conduct, jointly with the [Administrator](/usc/6/601.md?p=1), a study to determine the efficacy and feasibility of establishing specialized law enforcement deployment teams to assist [State](/usc/6/101.md?p=17), local, and [tribal governments](/usc/6/601.md?p=14) in responding to natural disasters, acts of [terrorism](/usc/6/101.md?p=18), or other man-made disasters and report on the results of that study to the [appropriate committees of Congress](/usc/6/601.md?p=2).
  - (5) **Rule of construction—** Nothing in this subsection shall be construed to diminish, supercede, or replace the responsibilities, authorities, or role of the [Administrator](/usc/6/601.md?p=1).
