# §606. Grants to directly eligible tribes

- (a) **In general—** Notwithstanding [section 605(b) of this title](/usc/6/605.md?p=b), the [Administrator](/usc/6/601.md?p=1) may award grants to [directly eligible tribes](/usc/6/601.md?p=4) under [section 605 of this title](/usc/6/605.md).
- (b) **Tribal applications—** A [directly eligible tribe](/usc/6/601.md?p=4) may apply for a grant under [section 605 of this title](/usc/6/605.md) by submitting an application to the [Administrator](/usc/6/601.md?p=1) that includes, as appropriate, the information required for an application by a [State](/usc/6/101.md?p=17) under [section 605(b) of this title](/usc/6/605.md?p=b).
- (c) **Consistency with State plans—**
  - (1) **In general—** To ensure consistency with any applicable [State](/usc/6/101.md?p=17) [homeland](/usc/6/101.md?p=1) security plan, a [directly eligible tribe](/usc/6/601.md?p=4) applying for a grant under [section 605 of this title](/usc/6/605.md) shall provide a copy of its application to each [State](/usc/6/101.md?p=17) within which any part of the tribe is located for review before the tribe submits such application to the [Department](/usc/6/101.md?p=5).
  - (2) **Opportunity for comment—** If the Governor of a [State](/usc/6/101.md?p=17) determines that the application of a [directly eligible tribe](/usc/6/601.md?p=4) is inconsistent with the [State](/usc/6/101.md?p=17) [homeland](/usc/6/101.md?p=1) security plan of that [State](/usc/6/101.md?p=17), or otherwise does not support the application, not later than 30 days after the date of receipt of that application the Governor shall—
    - (A) notify the [Administrator](/usc/6/601.md?p=1), in writing, of that fact; and
    - (B) provide an explanation of the reason for not supporting the application.
- (d) **Final authority—** The [Administrator](/usc/6/601.md?p=1) shall have final authority to approve any application of a [directly eligible tribe](/usc/6/601.md?p=4). The [Administrator](/usc/6/601.md?p=1) shall notify each [State](/usc/6/101.md?p=17) within the boundaries of which any part of a [directly eligible tribe](/usc/6/601.md?p=4) is located of the approval of an application by the tribe.
- (e) **Prioritization—** The [Administrator](/usc/6/601.md?p=1) shall allocate [funds](/usc/6/677a.md?p=5) to [directly eligible tribes](/usc/6/601.md?p=4) in accordance with the factors applicable to allocating [funds](/usc/6/677a.md?p=5) among [States](/usc/6/101.md?p=17) under [section 608 of this title](/usc/6/608.md).
- (f) **Distribution of awards to directly eligible tribes—** If the [Administrator](/usc/6/601.md?p=1) awards [funds](/usc/6/677a.md?p=5) to a [directly eligible tribe](/usc/6/601.md?p=4) under this section, the [Administrator](/usc/6/601.md?p=1) shall distribute the grant [funds](/usc/6/677a.md?p=5) directly to the tribe and not through any [State](/usc/6/101.md?p=17).
- (g) **Minimum allocation—**
  - (1) **In general—** In allocating [funds](/usc/6/677a.md?p=5) under this section, the [Administrator](/usc/6/601.md?p=1) shall ensure that, for each fiscal year, [directly eligible tribes](/usc/6/601.md?p=4) collectively receive, from the [funds](/usc/6/677a.md?p=5) appropriated for the [State](/usc/6/101.md?p=17) [Homeland](/usc/6/101.md?p=1) Security Grant Program established under [section 605 of this title](/usc/6/605.md), not less than an amount equal to 0.1 percent of the total [funds](/usc/6/677a.md?p=5) appropriated for grants under sections [604](/usc/6/604.md) and [605](/usc/6/605.md) of this title.
  - (2) **Exception—** This subsection shall not apply in any fiscal year in which the [Administrator](/usc/6/601.md?p=1)—
    - (A) receives fewer than 5 applications under this section; or
    - (B) does not approve at least 2 applications under this section.
- (h) **Tribal liaison—** A [directly eligible tribe](/usc/6/601.md?p=4) applying for a grant under [section 605 of this title](/usc/6/605.md) shall designate an individual to serve as a tribal liaison with the [Department](/usc/6/101.md?p=5) and other Federal, [State](/usc/6/101.md?p=17), local, and regional government officials concerning preventing, preparing for, protecting against, and responding to acts of [terrorism](/usc/6/101.md?p=18).
- (i) **Eligibility for other funds—** A [directly eligible tribe](/usc/6/601.md?p=4) that receives a grant under [section 605 of this title](/usc/6/605.md) may receive [funds](/usc/6/677a.md?p=5) for other purposes under a grant from the [State](/usc/6/101.md?p=17) or [States](/usc/6/101.md?p=17) within the boundaries of which any part of such tribe is located and from any [high-risk urban area](/usc/6/601.md?p=6) of which it is a part, consistent with the [homeland](/usc/6/101.md?p=1) security plan of the [State](/usc/6/101.md?p=17) or [high-risk urban area](/usc/6/601.md?p=6).
- (j) **State obligations—**
  - (1) **In general—** [States](/usc/6/101.md?p=17) shall be responsible for allocating grant [funds](/usc/6/677a.md?p=5) received under [section 605 of this title](/usc/6/605.md) to [tribal governments](/usc/6/601.md?p=14) in order to help those tribal communities achieve [target capabilities](/usc/6/601.md?p=13) not achieved through grants to [directly eligible tribes](/usc/6/601.md?p=4).
  - (2) **Distribution of grant funds—** With respect to a grant to a [State](/usc/6/101.md?p=17) under [section 605 of this title](/usc/6/605.md), an [Indian tribe](/usc/6/601.md?p=7) shall be eligible for funding directly from that [State](/usc/6/101.md?p=17), and shall not be required to seek funding from any [local government](/usc/6/101.md?p=13).
  - (3) **Imposition of requirements—** A [State](/usc/6/101.md?p=17) may not impose unreasonable or unduly burdensome requirements on an [Indian tribe](/usc/6/601.md?p=7) as a condition of providing the [Indian tribe](/usc/6/601.md?p=7) with grant [funds](/usc/6/677a.md?p=5) or resources under [section 605 of this title](/usc/6/605.md).
- (k) **Rule of construction—** Nothing in this section shall be construed to affect the authority of an [Indian tribe](/usc/6/601.md?p=7) that receives [funds](/usc/6/677a.md?p=5) under this part.
