# §574. Coordination of Department emergency communications grant programs

- (a) **Coordination of grants and standards programs—** The [Secretary](/usc/6/101.md?p=16), acting through the Assistant [Director](/usc/6/677a.md?p=3) for [Emergency](/usc/6/701.md?p=6) Communications, shall ensure that grant guidelines for the use of [homeland](/usc/6/101.md?p=1) security assistance administered by the [Department](/usc/6/101.md?p=5) relating to interoperable [emergency](/usc/6/701.md?p=6) communications are coordinated and consistent with the goals and recommendations in the National [Emergency](/usc/6/701.md?p=6) Communications Plan under [section 572 of this title](/usc/6/572.md).
- (b) **Denial of eligibility for grants—**
  - (1) **In general—** The [Secretary](/usc/6/101.md?p=16), acting through the Assistant [Secretary](/usc/6/101.md?p=16) for Grants and Planning, and in consultation with the Assistant [Director](/usc/6/677a.md?p=3) for [Emergency](/usc/6/701.md?p=6) Communications, may prohibit any [State](/usc/6/101.md?p=17), local, or [tribal government](/usc/6/701.md?p=16) from using [homeland](/usc/6/101.md?p=1) security assistance administered by the [Department](/usc/6/101.md?p=5) to achieve, maintain, or enhance [emergency](/usc/6/701.md?p=6) communications capabilities, if—
    - (A) such government has not complied with the requirement to submit a Statewide Interoperable Communications Plan as required by [section 194(f) of this title](/usc/6/194.md?p=f);
    - (B) such government has proposed to upgrade or purchase new equipment or systems that do not meet or exceed any applicable national [voluntary](/usc/6/671.md?p=6-A) consensus standards and has not provided a reasonable explanation of why such equipment or systems will serve the needs of the applicant better than equipment or systems that meet or exceed such standards; and
    - (C) as of the date that is 3 years after the date of the completion of the initial National [Emergency](/usc/6/701.md?p=6) Communications Plan under [section 572 of this title](/usc/6/572.md), national [voluntary](/usc/6/671.md?p=6-A) consensus standards for interoperable [emergency](/usc/6/701.md?p=6) communications capabilities have not been developed and promulgated.
  - (2) **Standards—** The [Secretary](/usc/6/101.md?p=16), in coordination with the Federal Communications Commission, the National Institute of Standards and Technology, and other Federal [departments](/usc/6/101.md?p=5) and [agencies](/usc/6/671.md?p=1) with responsibility for standards, shall support the development, promulgation, and updating as necessary of national [voluntary](/usc/6/671.md?p=6-A) consensus standards for interoperable [emergency](/usc/6/701.md?p=6) communications.
