# §467. Coordination with the Department of Health and Human Services under the Public Health Service Act

- (a) **In general—** The annual Federal response plan developed by the [Department](/usc/6/101.md?p=5) shall be consistent with section 319 of the Public Health Service Act ([42 U.S.C. 247d](/usc/42/247d.md)).
- (b) **Disclosures among relevant agencies—**
  - (1) **In general—** Full disclosure among relevant [agencies](/usc/6/311.md?p=2) shall be made in accordance with this subsection.
  - (2) **Public health emergency—** During the period in which the [Secretary](/usc/6/101.md?p=16) of Health and Human Services has declared the existence of a public health [emergency](/usc/6/701.md?p=6) under section 319(a) of the Public Health Service Act ([42 U.S.C. 247d(a)](/usc/42/247d.md?p=a)), the [Secretary](/usc/6/101.md?p=16) of Health and Human Services shall keep relevant [agencies](/usc/6/311.md?p=2), including the [Department](/usc/6/101.md?p=5) of [Homeland](/usc/6/101.md?p=1) Security, the [Department](/usc/6/101.md?p=5) of Justice, and the Federal Bureau of Investigation, fully and currently informed.
  - (3) **Potential public health emergency—** In cases involving, or potentially involving, a public health [emergency](/usc/6/701.md?p=6), but in which no determination of an [emergency](/usc/6/701.md?p=6) by the [Secretary](/usc/6/101.md?p=16) of Health and Human Services under section 319(a) of the Public Health Service Act ([42 U.S.C. 247d(a)](/usc/42/247d.md?p=a)), has been made, all relevant [agencies](/usc/6/311.md?p=2), including the [Department](/usc/6/101.md?p=5) of [Homeland](/usc/6/101.md?p=1) Security, the [Department](/usc/6/101.md?p=5) of Justice, and the Federal Bureau of Investigation, shall keep the [Secretary](/usc/6/101.md?p=16) of Health and Human Services and the [Director](/usc/6/677a.md?p=3) of the [Centers](/usc/6/681.md?p=1) for Disease Control and Prevention fully and currently informed.
