# §308602. United States African-American Burial Grounds Preservation Program

- (a) **In General.—** The [Secretary](/usc/54/308101.md?p=1) shall establish within the [Service](/usc/54/100102.md?p=4), in accordance with this chapter, a [program](/usc/54/308601.md?p=3) to be known as the “United States African-American [Burial Grounds](/usc/54/308601.md?p=1) Preservation [Program](/usc/54/308601.md?p=3)”.
- (b) **Duties of Secretary.—** In carrying out the [Program](/usc/54/308601.md?p=3), the [Secretary](/usc/54/308101.md?p=1), in consultation with the [National Trust](/usc/54/308702.md?p=1) for [Historic](/usc/54/308601.md?p=2) Preservation and members of the African-American heritage community, shall develop a [program](/usc/54/308601.md?p=3) for the provision of grants in accordance with [section 308603(a)](/usc/54/308603.md?p=a).
- (c) **Donations.—** The [Secretary](/usc/54/308101.md?p=1) may accept monetary donations to further the purposes of this chapter.
- (d) **Consent of Private Property Owner Required.—** [Burial grounds](/usc/54/308601.md?p=1) shall only be considered for a grant under the [Program](/usc/54/308601.md?p=3)—
  - (1) with the consent of the property owner; and
  - (2) at the request of an individual, landowner, private or nonprofit organization, State, Tribal, or local government, or other entity.
