# §305103. Selection of eligible entity and conveyance of historic light stations

- (a) **Process and Policies.—** The [Secretary](/usc/54/308101.md?p=1) and the [Administrator](/usc/54/305101.md?p=1) shall maintain a process and policies for identifying, and selecting, an [eligible entity](/usc/54/305101.md?p=2) to which a [historic light station](/usc/54/305101.md?p=4) could be conveyed for education, park, recreation, cultural, or [historic](/usc/54/308601.md?p=2) preservation purposes, and to monitor the use of the light station by the [eligible entity](/usc/54/305101.md?p=2).
- (b) **Application Review.—**
  - (1) **In general.—** The [Secretary](/usc/54/308101.md?p=1) shall—
    - (A) review all applications for the conveyance of a [historic light station](/usc/54/305101.md?p=4), when the agency with administrative jurisdiction over the [historic light station](/usc/54/305101.md?p=4) has determined the property to be excess property (as that term is defined in [section 102 of title 40](/usc/40/102.md)); and
    - (B) forward to the [Administrator](/usc/54/305101.md?p=1) a single approved application for the conveyance of the [historic light station](/usc/54/305101.md?p=4).
  - (2) **Consultation.—** When selecting an [eligible entity](/usc/54/305101.md?p=2), the [Secretary](/usc/54/308101.md?p=1) shall consult with the [State Historic Preservation Officer](/usc/54/308702.md?p=4) of the State in which the [historic light station](/usc/54/305101.md?p=4) is located.
- (c) **Conveyance or Sale of Historic Light Stations.—**
  - (1) **Conveyance by administrator.—** Except as provided in [paragraph (2)](#c-2), after the [Secretary](/usc/54/308101.md?p=1)’s selection of an [eligible entity](/usc/54/305101.md?p=2), the [Administrator](/usc/54/305101.md?p=1) shall convey, by quitclaim deed, without consideration, all right, title, and interest of the United States in and to a [historic light station](/usc/54/305101.md?p=4), subject to the conditions set forth in [section 305104 of this title](/usc/54/305104.md). The conveyance of a [historic light station](/usc/54/305101.md?p=4) under this chapter shall not be subject to the McKinney-Vento Homeless Assistance Act ([42 U.S.C. 11301](/usc/42/11301.md) et seq.) or section 416(d) of the Coast Guard Authorization Act of 1998 (Public Law 105–383, [14 U.S.C. 93](https://uscode.house.gov/view.xhtml?req=(/us/usc/t14/s93)) note).[^1]
  - (2) **Historic light station located within a system unit or a refuge within national wildlife refuge system.—**
    - (A) **Approval of secretary required.—** A [historic light station](/usc/54/305101.md?p=4) located within the exterior boundaries of a [System unit](/usc/54/100102.md?p=6) or a refuge within the National Wildlife Refuge [System](/usc/54/100102.md?p=5) shall be conveyed or sold only with the approval of the [Secretary](/usc/54/308101.md?p=1).
    - (B) **Conditions of conveyance.—** If the [Secretary](/usc/54/308101.md?p=1) approves the conveyance of a [historic light station](/usc/54/305101.md?p=4) described in [subparagraph (A)](#c-2-A), the conveyance shall be subject to the conditions set forth in [section 305104 of this title](/usc/54/305104.md) and any other terms or conditions that the [Secretary](/usc/54/308101.md?p=1) considers necessary to protect the resources of the [System unit](/usc/54/100102.md?p=6) or wildlife refuge.
    - (C) **Conditions of sale.—** If the [Secretary](/usc/54/308101.md?p=1) approves the sale of a [historic light station](/usc/54/305101.md?p=4) described in [subparagraph (A)](#c-2-A), the sale shall be subject to the conditions set forth in paragraphs (1) to (4) and (8) of subsection (a), and subsection (b), of [section 305104 of this title](/usc/54/305104.md) and any other terms or conditions that the [Secretary](/usc/54/308101.md?p=1) considers necessary to protect the resources of the [System unit](/usc/54/100102.md?p=6) or wildlife refuge.
    - (D) **Cooperative agreements.—** The [Secretary](/usc/54/308101.md?p=1) is encouraged to enter into cooperative agreements with appropriate [eligible entities](/usc/54/305101.md?p=2) with respect to [historic light stations](/usc/54/305101.md?p=4) described in [subparagraph (A)](#c-2-A), as provided in this division, to the extent that the cooperative agreements are consistent with the [Secretary](/usc/54/308101.md?p=1)’s responsibilities to manage and administer the [System unit](/usc/54/100102.md?p=6) or wildlife refuge.
