# §302705. Agreement for review under tribal historic preservation regulations


The [Council](/usc/54/311101.md?p=1) may enter into an agreement with an Indian tribe to permit undertakings on tribal land to be reviewed under tribal [historic](/usc/54/308601.md?p=2) preservation regulations in place of review under regulations promulgated by the [Council](/usc/54/311101.md?p=1) to govern compliance with [section 306108 of this title](/usc/54/306108.md), if the [Council](/usc/54/311101.md?p=1), after consultation with the Indian tribe and appropriate [State Historic Preservation Officers](/usc/54/308702.md?p=4), determines that the tribal preservation regulations will afford [historic property](/usc/54/308901.md?p=3) consideration equivalent to that afforded by the [Council](/usc/54/311101.md?p=1)’s regulations.
