# §302701. Program to assist Indian tribes in preserving historic property

- (a) **Establishment of Program.—** The [Secretary](/usc/54/308101.md?p=1) shall establish a [program](/usc/54/308601.md?p=3) and promulgate regulations to assist Indian tribes in preserving their [historic property](/usc/54/308901.md?p=3).
- (b) **Communication and Cooperation.—** The [Secretary](/usc/54/308101.md?p=1) shall foster communication and cooperation between Indian tribes and [State Historic Preservation Officers](/usc/54/308702.md?p=4) in the administration of the national [historic](/usc/54/308601.md?p=2) preservation [program](/usc/54/308601.md?p=3) to—
  - (1) ensure that all types of [historic property](/usc/54/308901.md?p=3) and all public interests in [historic property](/usc/54/308901.md?p=3) are given due consideration; and
  - (2) encourage coordination among Indian tribes, [State Historic Preservation Officers](/usc/54/308702.md?p=4), and Federal agencies in [historic](/usc/54/308601.md?p=2) preservation planning and in the identification, evaluation, [protection](/usc/54/302501.md?p=2), and interpretation of [historic property](/usc/54/308901.md?p=3).
- (c) **Tribal Values.—** The [program](/usc/54/308601.md?p=3) under [subsection (a)](#a) shall be developed in a manner to ensure that tribal values are taken into account to the extent feasible. The [Secretary](/usc/54/308101.md?p=1) may waive or modify requirements of this subdivision to conform to the cultural setting of tribal heritage preservation goals and objectives.
- (d) **Scope of Tribal Programs.—** The tribal [programs](/usc/54/308601.md?p=3) implemented by specific tribal organizations may vary in scope, as determined by each Indian tribe’s chief governing authority.
- (e) **Consultation.—** The [Secretary](/usc/54/308101.md?p=1) shall consult with Indian tribes, other Federal agencies, State [Historic](/usc/54/308601.md?p=2) Preservations[^1] Officers, and other interested parties concerning the [program](/usc/54/308601.md?p=3) under [subsection (a)](#a).
