# §302301. Regulations


The [Secretary](/usc/54/308101.md?p=1), in consultation with the National Conference of [State Historic Preservation Officers](/usc/54/308702.md?p=4) and the [National Trust](/usc/54/308702.md?p=1), shall promulgate regulations for State [Historic](/usc/54/308601.md?p=2) Preservation [Programs](/usc/54/308601.md?p=3). The regulations shall provide that a State [program](/usc/54/308601.md?p=3) submitted to the [Secretary](/usc/54/308101.md?p=1) under this chapter shall be approved by the [Secretary](/usc/54/308101.md?p=1) if the [Secretary](/usc/54/308101.md?p=1) determines that the [program](/usc/54/308601.md?p=3) provides for—

- (1) the [designation](/usc/54/302501.md?p=1) and appointment by the chief elected official of the State of a [State Historic Preservation Officer](/usc/54/308702.md?p=4) to administer the [program](/usc/54/308601.md?p=3) in accordance with [section 302303 of this title](/usc/54/302303.md) and for the employment or appointment by the officer of such professionally qualified staff as may be necessary for those purposes;
- (2) an adequate and qualified State [historic](/usc/54/308601.md?p=2) preservation review [board](/usc/54/305301.md?p=1) designated by the [State Historic Preservation Officer](/usc/54/308702.md?p=4) unless otherwise provided for by State law; and
- (3) adequate public participation in the State [Historic](/usc/54/308601.md?p=2) Preservation [Program](/usc/54/308601.md?p=3), including the process of recommending properties for nomination to the National Register.

In paragraph (1), the words “chief elected official” are substituted for “Governor” for clarity because the definition of “State” in section 300316 of the new title includes entities in which the chief elected official is not the Governor.
