# §4585. Public database of covered foreign persons

- (a) **In general—** The [Secretary](/usc/50/4589.md?p=11), in consultation with the [Secretary](/usc/50/4589.md?p=11) of Commerce, may establish a publicly accessible, non-exhaustive database that identifies [covered foreign persons](/usc/50/4589.md?p=3) that are either engaged in a [prohibited technology](/usc/50/4589.md?p=10-A) or a [notifiable technology](/usc/50/4589.md?p=7-A) pursuant to this subchapter.
- (b) **Modification process—** The [Secretary](/usc/50/4589.md?p=11), in consultation with the [Secretary](/usc/50/4589.md?p=11) of Commerce, is authorized to establish a mechanism for a [covered foreign person](/usc/50/4589.md?p=3) to petition for their removal from or inclusion in the publicly accessible, non-exhaustive database described in (a).[^1]
- (c) **Confidentiality of evidence—** The [Secretary](/usc/50/4589.md?p=11) shall establish a mechanism for the public, including Congress, stakeholders, investors, and nongovernmental organizations, to submit evidence on a confidential basis regarding whether a [foreign person](/usc/50/4589.md?p=5) is a [covered foreign person](/usc/50/4589.md?p=3) in a [prohibited technology](/usc/50/4589.md?p=10-A) or [notifiable technology](/usc/50/4589.md?p=7-A) and should be included in the database described in [subsection (a)](#a), if any.
- (d) **Rule of construction—** The database described in [subsection (a)](#a), if any, shall not be considered to be an exhaustive or comprehensive list of [covered foreign persons](/usc/50/4589.md?p=3) for the purposes of this subchapter.
