# §3934. Stay or vacation of execution of judgments, attachments, and garnishments

- (a) **Court action upon material affect determination—** If a [servicemember](/usc/50/3911.md?p=1), in the opinion of the [court](/usc/50/3911.md?p=5), is materially affected by reason of [military service](/usc/50/3911.md?p=2) in complying with a [court](/usc/50/3911.md?p=5) [judgment](/usc/50/3911.md?p=9) or order, the [court](/usc/50/3911.md?p=5) may on its own motion and shall on application by the [servicemember](/usc/50/3911.md?p=1)—
  - (1) stay the execution of any [judgment](/usc/50/3911.md?p=9) or order entered against the [servicemember](/usc/50/3911.md?p=1); and
  - (2) vacate or stay an attachment or garnishment of property, money, or debts in the possession of the [servicemember](/usc/50/3911.md?p=1) or a third party, whether before or after [judgment](/usc/50/3911.md?p=9).
- (b) **Applicability—** This section applies to an action or proceeding commenced in a [court](/usc/50/3911.md?p=5) against a [servicemember](/usc/50/3911.md?p=1) before or during the period of the [servicemember](/usc/50/3911.md?p=1)’s [military service](/usc/50/3911.md?p=2) or within 90 days after such service terminates.
