# §8913. Regulations

- (a) The [Office](/usc/5/5402.md?p=3) of Personnel Management may prescribe regulations necessary to carry out this chapter.
- (b) The regulations of the [Office](/usc/5/5402.md?p=3) may prescribe the time at which and the manner and conditions under which an [employee](/usc/5/4701.md?p=a-2) is [eligible](/usc/5/4701.md?p=a-3) to enroll in an approved [health benefits plan](/usc/5/8901.md?p=6) described by section [8903](/usc/5/8903.md) or [8903a](/usc/5/8903a.md) of this title. The regulations may exclude an [employee](/usc/5/4701.md?p=a-2) on the basis of the nature and type of his employment or conditions pertaining to it, such as short-term appointment, seasonal or intermittent employment, and employment of like nature. The [Office](/usc/5/5402.md?p=3) may not exclude—
  - (1) an [employee](/usc/5/4701.md?p=a-2) or group of [employees](/usc/5/4701.md?p=a-2) solely on the basis of the hazardous nature of employment;
  - (2) a teacher in the employ of the [Board](/usc/5/8401.md?p=5) of Education of the District of Columbia, whose [pay](/usc/5/7511.md?p=a-4) is fixed by [section 1501 of title 31](/usc/31/1501.md), District of Columbia Code, on the basis of the fact that the teacher is serving under a temporary appointment if the teacher has been so employed by the [Board](/usc/5/8401.md?p=5) for a period or periods totaling not less than two school years;
  - (3) an [employee](/usc/5/4701.md?p=a-2) who is occupying a [position](/usc/5/5102.md?p=a-3) on a [part-time career employment](/usc/5/3401.md?p=2) basis (as defined in [section 3401(2) of this title](/usc/5/3401.md?p=2)); or
  - (4) an [employee](/usc/5/4701.md?p=a-2) who is employed on a temporary basis and is [eligible](/usc/5/4701.md?p=a-3) under [section 8906a(a)](/usc/5/8906a.md?p=a).
- (c) The regulations of the [Office](/usc/5/5402.md?p=3) shall provide for the beginning and ending dates of coverage of [employees](/usc/5/4701.md?p=a-2), [annuitants](/usc/5/8401.md?p=2), [members](/usc/5/8401.md?p=20) of their families, and [former spouses](/usc/5/8401.md?p=12) under [health benefits plans](/usc/5/8901.md?p=6). The regulations may permit the coverage to continue, exclusive of the temporary extension of coverage described by [section 8902(g) of this title](/usc/5/8902.md?p=g), until the end of the [pay](/usc/5/7511.md?p=a-4) period in which an [employee](/usc/5/4701.md?p=a-2) is separated from the [service](/usc/5/8401.md?p=26), or until the end of the month in which an [annuitant](/usc/5/8401.md?p=2) or [former spouse](/usc/5/8401.md?p=12) ceases to be entitled to annuity, and in case of the death of an [employee](/usc/5/4701.md?p=a-2) or [annuitant](/usc/5/8401.md?p=2), may permit a temporary extension of the coverage of [members](/usc/5/8401.md?p=20) of his family for not to exceed 90 days.
- (d) The [Secretary](/usc/5/9901.md?p=2) of Agriculture shall prescribe regulations to effect the application and operation of this chapter to an individual named by [section 8901(1)(H) of this title](/usc/5/8901.md?p=1-H).

In subsection (b)(2), the words “section 1501 of title 31, District of Columbia Code” are substituted for “section 1 of the District of Columbia Teachers’ Salary Act of 1955 (69 Stat. 521), as amended (sec. 31–1501, D.C. Code, 1961 edition)”.
